On 09/22/2022, Licensing Program Analyst (LPA) Stacy Torrence conducted an in-person inspection to deliver the findings regarding the above complaint allegations. LPA Torrence met with Head of Schools, Samantha Madrigal. There was a total of 39 preschool children, with 12 staff supervising. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 06/27/2022, Licensing office received a complaint alleging the following: Day care child(ren) were bullied by other day care children while in care and day care child(ren) were pushed by other day care child while in care.
During the investigation, LPA interviewed the Reporting Party (RP). RP reported to the licensing office that RP pulled RP’s child out of the school because of lack of staff supervision and RP’s child being bullied by another child. RP stated RP’s child said the teachers witnessed it, and child reported to the teachers and they never intervened or stopped it. RP stated RP’s child told the teachers and the teachers told RP’s child to tell the other child to stop. RP stated on 06/27/2022, a parent, told RP of witnessing four kids bullying the parent’s child and there were several teachers just standing around and watching it.

Allegation: day care child(ren) were bullied by other day care children while in care:
During the investigation, LPA contacted seven parents and interviewed four parents. Parent 1(P1) reported witnessing P1’s child being bullied. P1 stated in the morning, during drop off, there are different sections where children line up. P1 stated there were 4-5 teachers around, but they were all in one corner, a blind spot where they couldn’t see the children. P1 stated this incident was reported to the director and director stated she was sorry and will ask the teachers about it. Other interviewed parents had no issues or concerns.

During the course of the investigation, LPA Torrence received an email from the director, addressing P1’s concerns. Per email, P1 expressed concerns regarding teachers not being in the exact area that P1’s child was in. In the email, the director explained their drop-off and transitioning of students to line up, in which, classes line up in different areas of the playground with teachers in close proximity. LPA asked the director, how it was known where the teachers were located, director disclosed that after speaking with staff a total of 6 who were on the playground who all described their locations and the locations of the other staff on the playground at the time.

During the course of the investigation, LPA Torrence interviewed seven staff members. Staff 1 (S1) stated standing in the doorway to go into the playground and had straight view of P1 talking to the four kids and didn’t think nothing of it. Interviewed staff denied witnessing any type of bullying on the playground or in the classroom. S3 stated if they noticed any type of bullying, they intervene and communicate with the children and parents.

During the course of the investigation, LPA review video footage dated 06/27/2022, of the playground during drop off, which depicted two teachers on the playground watching the children.

Interviewed staff denied witnessing any children being pushed or harassed by another child.

During the course of the investigation, LPA Torrence interviewed four qualified children. There was no disclosure made by interviewed children. LPA Torrence interviewed one qualified Subject Child. There was no disclosure made by the qualified child.

Based on LPA’s interviews and review of video footage, there was insufficient evidence to corroborate the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are unsubstantiated.

Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided through email and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
