On 9/25/2025, Licensing Program Analyst (LPA) Vivian Trinh conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 6/19/2025. LPA Trinh met with Facility representative Kimberly Sanders, who led LPA on a tour of the facility. At the time of the investigation, a total of nine (9) Infant children with four (4) staff members were observed. 3 toddler children with one (1) staff member. The facility representative stated the Director is on Vacation. LPA informed the Facility representative, Kimberly Sanders, of the purpose of the visit.

A review of staff criminal clearance records on this date 9/25/2025 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 8/22/2025, the Orange County Child Care Office received a complaint alleging that (1) Staff do not ensure that infant food is labeled and dated. (2) Staff do not ensure that infant equipment is kept clean and sanitary. (3) Staff do not ensure that proper napping equipment is used when the child is sleeping. (4) Staff feed a child the food from another child.

During the investigation, LPA conducted facility visits on 6/19/2025. LPA Trinh interviewed 8 staff members and five (5) parents. LPA did not interview the infant children due to their age being too young and not being qualified. LPA Trinh also reviewed records: these included the LIC 500 Personnel Report, LIC 9040 Children’s Roster, the Personnel Handbook, and a receipt for the services yearly from IBEX Building Services (cleaning services) from March 2025 through August 2025. A declaration, A receipt of Costco, and Sam Club’s invoices, and obtained the picture from the facility.

Regarding the allegation (1) “Staff do not ensure that infant food is labeled and dated.” During visits on 8/19/25, and today 9/25/25. LPA observed each infant and toddler classroom has a refrigerator with a basket of milk and food labeled with the child's name. LPA obtained the pictures. LPA interviewed eight (8) staff members, all of whom stated that the staff member receiving a child in the morning will double-check the lunch bag with the children's food labels. Additionally, throughout the day, if staff members notice items that need labeling, they will label them accordingly. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding allegation (2), the Staff does not ensure that infant equipment is kept clean and sanitary”. During the visit on 8/19/25, LPA observed that the infant and toddler toys on counters, highchairs, teething toys, pillows, and push toys, were clean. During staff interviews, one (1) out of eight (8) staff members stated that they observed Staff #4 (S4) give dirty teething toys to an infant; however, other staff members were able to intervene and reminded S4 to provide clean teething toys to the infants as needed. It was not confirmed if the infant had already put the dirty teething toys in their mouth. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding the allegation (3), “Staff do not ensure that proper napping equipment is used when the child is sleeping”. During the visit and inspection on 8/19/2025, LPA observed an infant asleep in the crib and one (1) staff member supervising the infant in the napping area. LPA obtained a picture of the napping area. During staff interviews, one 1 out of eight 8 interviewed staff members stated that while S4 was in the infant classroom, S4 held the infants even after the infants had fallen asleep. (1) one staff member stated that they reminded S4 to move the sleeping infant into the crib, and S4 did.

Regarding allegation (4) the Staff fed a child the food from another child. During the visit and inspection on 8/19/2025, around 11:15 a.m. and 11:30 a.m., as well as today, 9/25/25, between 1:00 pm and 1:30 pm, LPA observed the infant classroom during mealtime time. Two (2) infants were wearing bibs and seated inside the highchairs. One (1) staff member sat in a chair between the two (2) infants, took food out of the refrigerator with the child's name on the container, looked at each infant’s face, and placed the food container on the highchair. One (1) out of eight (8) staff members stated that they witnessed S4 giving the wrong food to the infants but could not identify which infant was given the wrong food. All five (5) interviewed parents did not disclose any information related to the allegation.

Based on observations, interviews, and record reviews, there is not a preponderance of evidence to prove that the (1) Staff do not ensure that infant food is labeled and dated, (2) Staff do not ensure that infant equipment is kept clean and sanitary, (3) Staff do not ensure that proper napping equipment’s when the child is sleeping and (4) Staff feed a child the food from another child. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day-care facility; therefore, the listed allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative Kimberly Sanders was provided a copy of their appeal rights. The facility representative Kimberly Sanders was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
