On 05/31/2022, Licensing Program Analyst (LPA) Tina Nguyen conducted an unannounced visit to deliver the findings regarding the above complaint allegation. This complaint investigation had been started on 03/04/2022 by LPA Tina Nguyen. LPA Nguyen met with office assistant Candace Galvan (Hoodye). LPA Nguyen touted the facility. The Covid-19 Emergency Response questionnaires were asked.
There was a total of 83 preschool children with 8 staff observed during the inspection. The facility is licensed to care for 82 children age 2-6 years of age. The facility is operating over capacity during today's visit. A Case management report LIC 809 date 05/31/2022 will be created to cite for over capacity.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 03/04/2022, our office received a complaint, and the complainant reported that Staff inappropriately discipline children in care. The complainant disclosed a staff member pulled a child’s hair and also pinched the child. Continue on page 2

Facility representative reported the incident to Licensing office on 03/04/2022, compliant with reporting requirement regulations.

During the investigation, LPA interviewed 4 staff members and no disclosures were made by any staff member. All interviewed staff members denied of pulling the child’s hair or pinching the child. No staff members disclosed witnessing any staff pulling any child’s hair or pinching the child. All interviewed staff stated if the children misbehaved or did not listen to the staff, the teacher would talk to the children and try to redirect the children to different activities. Staff #3 (S3) disclosed on March 4, 2022, S3 was standing outside the 2 years old classroom and observed the children were pushing the cubby. S3 observed S1 put S1’s hand softly on Child 1 (C1)’s head to redirect C1 to get away from the cubby. At no time, S3 observed S1 pulled C1’s hair or any child’s hair.

LPA Nguyen contacted five parents by phone and was able to interview two parents. All two interviewed parents stated they like the facility and all staff members are very nice, friendly, and professional. The parents also indicated they would refer the facility to their friends and family. Interviewed parents also stated they did not have any concern or issue with the facility; Interviewed parents never witnessed any staff member handling children roughly.

LPA Nguyen also conducted an interview with 4 children. However, children were too young and not qualified for an interview.

Based on the information gathered from LPAs' interviews and reviewing records, there is insufficient evidence to corroborate the allegation of Staff inappropriately discipline children in care. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged staff are handling child roughly did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) was provided. First level appeal is to Regional Manager, address is above on the report.
