On 11/18/21 the Orange County Child Care Office received a complaint alleging facility does not provide a safe environment for children in care. When the complaint was called in, the reporting party (RP) stated staff could work without a physical, proof of immunizations, and proof of TB test. LPA attempted to contact RP but was unsuccessful.
As stated in Title 22 Section 101216(g) all personnel, including the licensee, administrator and volunteers shall be in good health and shall be physically and mentally capable of performing assigned tasks. Good physical health shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. During the investigation LPA obtained copies of Health Screening Report form LIC 503 for 9 staff. A review of documents revealed 1 of 9 staff (S3) had their TB test performed more than one year prior to employment; 2 of 9 staff (S1 and S4) had their TB test performed more than seven days after employment; and 1 of 9 staff (S2) did not have proof of TB test and physical in their file. Immunization records were reviewed for 9 staff and were in compliance.
Based on records reviewed, the licensee failed to ensure staff are in good physical health verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment or licensure. This requirement was not met as evidenced by 3 of 9 staff TB tests were outside the time frame required by the regulation and 1 of 9 staff did not have proof of TB test and physical on file. Therefore, the preponderance of evidence standard has been met, therefore the above allegation alleging facility does not provide a safe environment for children in care is found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101216 (g) (1), is being cited on the attached LIC 9099D.
101216 Personnel Requirements
(g) All personnel, including the licensee, administrator and volunteers, shall be in good health and shall be physically and mentally capable of performing assigned tasks.
