Licensing Program Analyst (LPA), Mila Quinto conducted an investigation visit to the facility to deliver the finding. Upon arrival, LPA met with director, Margarita Calero. Census was taken. There was a total of 21 preschool children with 4 staff member.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The complainant alleged that staff member yells at daycare children.

On 8/4/2023 and 8/9/2023, LPA conducted an interview with 6 staff members including the director. According to the director, staff do not yell at children, however staff talk in a loud firm voice. 2 of the 6 staff stated staff yell at children in a stern demanding tone and this happens frequently. There was no statement from the 3 staff members.

On 8/4/2023, LPA interviewed 3 preschool children. There were no disclosures from the 3 preschool children interviewed .

On 8/10/2023, LPA called 9 parents and interviewed 5 of the 9 parents. 1 of 5 parents interviewed stated that they have observed staff speaking to children as if they are scolding them and the staff do not know how to communicate at a children’s level. There were no disclosures made from the 4 parents interviewed. LPA did not receive a return call from the 4 parents.

Based on interviews conducted with staff, the complainant alleged staff member yells at daycare children is found to be Substantiated. A substantiated finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met.

The following violation was revealed and is being cited in accordance with California Code of Regulations, Title 22, Division 12, 101223(a) (1) Personal Rights. Please refer to attached 9099 (D).

An exit interview conducted with director. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.

The Notice of Site Visit was posted and discussed as required by H&S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00. The Notice of Site Visit must be posted on or adjacent to the door.
