Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. LPA met with director, Margarita Calero. Census was taken. The overall census observed was 3 staff and 17 children. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 8/15/23 a complaint was filed with the Licensing office stating staff yelled at daycare children and Staff are not supervising children. Reporting Party (RP) stated the following: Staff would yell, “I told you don’t do that” to the children. Staff members are on their phones texting and not attending to daycare children.

During the course of investigation, LPA interviewed 4 staff, 3 parents, 3 children and reviewed records.

Regarding allegation: “Staff yells at children”, during the staff interview, 4 out of 4 staff have not witnessed staff yelling at daycare children. Staff #3 (S3) stated the following: “ No. S1 has a loud voice so it may be perceived as yelling but S1 doesn’t yell at the children.” S4 stated “S2 raises their voice if she needs to get a child’s attention but not yelling.”

Regarding allegation: “Staff are not supervising children”, during the staff interview, 4 out of 4 staff stated they have not witnessed staff not supervising children. S1 stated the following: “No, if somebody text me on my phone, I only text on my break, so I can respond to text. S4 stated, “No, but staff have it on them. Staff keep their cell phones with them in case of an emergency.”

LPA requested to review facility’s footage, director stated facility only having live footage, LPA was unable to review.

LPA observed staff engaging with children, staff were observed sitting at child’s eye level at the tables in the classroom with children providing age-appropriate activities for children.

LPA Duron interviewed 3 children. 3 out of 3 children did not disclose any information.

LPA Duron interviewed 3 parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPAs’ interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of Staff yelled at daycare children and Staff are not supervising children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.



The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Page 2 of 2. End of Report.
