Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. LPA met with director, Margarita Calero. Census was taken. The overall census observed was 3 staff and 17 children. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 9/14/23 a complaint was filed with the Licensing office stating facility is operating out of ratio. Reporting Party (RP) stated the following: the preschool program has been operating out of ratio for a few months due to the facility being short staffed. RP states on 09/13/2023 at approximately 5:20 p.m. there were 16 preschool children ages two to four years with 1 staff.

On 9/19/23 LPA Duron arrived at Fullerton Academy facility at 5:20pm. LPA observed 4 staff including Director with 13 preschool age children.

On 9/22/23 LPA returned to the facility and interviewed 3 children and reviewed children sign in & out sheets along with staff timecards. Dated 9/13/23 at 5:30pm the facility had 8 children with 5 staff, including the Director. By 5:40pm there were 4 children with 3 staff, including the Director at the facility.

During the course of investigation, LPA interviewed 5 staff, 3 parents, 3 children and reviewed records.

During the staff interview, 5 out of 5 staff stated facility has not been operating out of ratio. S2 stated, on 9/13/23, the facility had 10 children with 3 teachers at 5:20pm. S4 stated, on 9/13/23, facility had no more than 10 or 12 children, and about 3 staff at 5:20 pm S5 stated, on 9/13/23 the facility had around 10-13 children with 3 staff at 5:20 pm.

LPA Duron interviewed three parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPA's interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of facility is operating out of ratio. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the allegation did or did not occur in the day care facility, therefore the allegations is UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.



The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
