Licensing Program Analysts (LPAs), Mila Quinto and Patricia Duron conducted an investigation visit to the facility to deliver the findings. LPA met with Director, Nadhira Hathotuwegama. The Covid-19 Emergency Response questionnaire was reviewed and answered by the director. Census was taken. There was a total of 20 preschool children with 6 staff in different classrooms.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The complainant alleged staff did not administer first aid to Child 1’s(C1) injuries as needed. The complainant stated C1 came home with a wound on the knee and first aid was not administered, the wound area was the size of a dime bloody and soaked through C1’s pants.

On 6/29/22 and 7/7/2022, LPA conducted an interview with 4 staff members. Staff 2 (S2) is the lead teacher in C1’s classroom. S2 stated saw C1 fall on the playground and sustained a scratch on C1’s elbow. The elbow was cleaned by S2 and no other visible injuries observed. S2 did not observe any other injuries. S3 stated changed C1’s diaper and pulled down C1’s pants enough to change the diapers and did not pull the pants all the way down. S3 stated did not observe any injuries on C1. According to the Director, staff do not remove clothing even during daily health screening to protect their rights. No disclosure made from 1 of 4 staff.

LPA reviewed C1 file and no incident report found. The Director stated all incident reports are sent in bright wheel application message to parents. The Director provided a copy of the incident report from bright wheel application for C1 dated 9/22/21 and 6/21/22. No other incident report found.

LPA was not able to interview C1 as the parent did not feel C1 remember the incidents.

On 6/29/22, LPA attempted to interview 7 preschools, 4 of the 7 were verbal and stated when they get hurt they tell their teacher and the teacher puts a band aid on their Ouchy.

On 8/4/22, LPA called 11 parents and interviewed the 4 of the 11 parents who returned LPAs call. There were no disclosures made from the 4 parents interviewed. LPA did not receive a return call from the other 7 parents.

Based on interviews conducted, the complaint alleging staff did not administer first aid to child's injuries as needed is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

The complainant alleged the behavior and health of the child was not continually observed throughout the period of attendance. According to the complainant, C1 had sustained scratches/injuries when attended the facility and was not communicated to the parents.

On 6/29/22 and 7/7/2022, LPA conducted an interview with 4 staff members. Staff 1 stated an email was received from parent of C1 regarding the injury sustained on 6/21/22. S1 also indicated the parent of C1 stated C1 had sustained injuries, however there was no mention in the past from the parents of C1’s injuries. S2 stated when C1 would trip or fall at the playground, S2 will examine for any injuries or cuts. C1 will usually get up and continue to play after a trip or fall. The Director indicated was not aware of any injuries the parents mentioned and unsure if they were sustained in the facility or elsewhere. No disclosure made from 1 of 4 staff members.

The complainant alleged injuries requiring assessment and/or administration of first aid by staff were not reported to the child's authorized representative and/or recorded in the child's record. According to the complainant, the child care facility did not inform the parents of child’s injury on 6/21/22.

On 6/29/22 and 7/7/2022, LPA conducted an interview with 4 staff members. According to the Director, when child has a major injury, a phone call is made to the parents. However, for any minor injuries, no phone calls are made to the parents. According to S1, an incident report was generated on 6/21/22 to send to the parents through the bright wheel application. However, the message was not sent until the following day on 6/22/22. S2 stated informed S1 of the incident and a report was generated on the bright wheel application and forwarded to S1 to send to the parents.

LPA reviewed C1 file and no incident report found. The Director stated all incident reports are sent in bright wheel application message to parents. The Director provided a copy of the incident report from bright wheel application for C1 dated 9/22/21 and 6/21/22. No other incident report found.

The Director stated all staff have CPR/First Aid Training and renew them every 2 years and during staff trainings, staff will conduct a refresher training on first aid.

LPA received a copy of the parent handbook and reviewed the section on Bumps, Bruises, and Scrapes.
