32 | The Department received a Complaint on 2/12/2024 alleging (1) Staff handled child in a rough manner (2) Staff do not keep the facility clean and sanitary. (3) Staff are providing care and supervision to children prior to receiving a fingerprint clearance.
On 2/15/2024, LPA interviewed six (6) staff at the facility. Four (4) out of six (6) staff stated they have witnessed Staff #1 (S1) handle children in a rough manner. 4 Staff witnessed S1 grab and push a child down during diaper change and the child would start crying. On 2/15/24, All 6 staff stated that the carpet in the infant room needs cleaning and maintenance. 5 Staff stated that dust and dirt sticks to children’s skin and clothes. LPA was shown photos of infants with dust and dirt on their skin and clothing after crawling on the carpeted floor. See LIC9099D for 2 Type B deficiencies cited.
Based on records reviewed and interview, one (1) staff, Staff 2 (S2) started employment in the facility before receiving criminal record clearance. S2 started employment at the facility in July 31, 2023 and Criminal Record Clearance shows S2 was eligible in August 25, 2023. See LIC9099D for 1 Type A deficiency cited.
On 3/11/2024, LPA called 10 parents. LPA reached four (4) parents. None of the parents interviewed disclosed any information that could support the allegations.
Based on interviews conducted, records reviewed and observations, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. A substantiated finding means that the complaint is substantiated, and the allegations are valid because the preponderance of the evidence standard has been met. See LIC9099D for 1 Type A and 2 Type B deficiencies cited and Civil penalty is assessed for the Type A violation.
LPA Chan informed Director Karen Villanueva-Diaz, that this report dated 04/18/2024 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Director to provide a copy of this licensing report dated 04/18/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
