On 5/23/2024, at 10:00am Licensing Program Analyst (LPA), Anna Chan conducted an unannounced Complaint investigation inspection. The purpose of the investigation is to deliver findings from a complaint initiated on 4/22/2024. Upon arrival, LPA met with Director Amanda Gonzalez. LPA explained the reason for today's visit upon arrival. Census was taken in individual classrooms. LPA observed 8 infants and 2 staff.

A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance.

The Department received a complaint on 04/17/24 alleging (1) Staff are not properly storing play materials. (2) Staff are not providing a shade area for day care children.

Based on LPA observations and inspection on 4/22/24, the rugs and mats in the infant outdoor play area had crawling roly polies and other insects under the rug when it was lifted and dirt was all over the damp rug or mat. LPA also observed a rectangular bucket (shoe box size) with brownish colored stagnant water. There are plastic rods that came off from the old shade. LPA also observed there were no shade in the outdoor area.

Based on staff interview on 4/22/24, Staff #1 (S1) stated the staff cleans the infant outdoor area every morning, but has not that day. Four (4) staff stated the shade in the outdoor area broke a few months ago leaving the infant outdoor play area without shade. Staff #4 (S4) stated, the facility had a plan to build a roller shade but have not yet scheduled with any company to start the work.

On 5/20/2024, LPA called parents eight (8) parents. LPA reached 3 parents. None of the parents interviewed disclosed information that could support the allegations.

Based on observation, inspection, and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. See LIC9099D 2 Type B

Exit interview was conducted, report and deficiencies were reviewed with Director Amanda Gonzalez. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The Director was provided with a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
