32 | On 5/8/25 the Orange County Child Care Office received a complaint alleging (1) Staff inappropriately disciplined daycare child. Reporting Party (RP) stated the following: Child#1 (C1) has been inappropriately disciplined on a regular basis while in care. When C1 misbehaves Staff#1 (S1) often responds by grabbing C1 and giving C1 a bear hug, holding C1 tightly until C1 calms down or listens.
During the investigation, LPA toured the facility, interviewed 9 staff members, attempted to interview 8 children but only 5 children qualified for an interview, and obtained a copy of the personnel report and children’s rosters.
During staff interviews, 9 out of 9 staff members stated they have not observed a staff member roughly grab a child. 9 out of 9 staff members have not observed staff members hugging children tightly to calm them down. S1 denied grabbing and hugging children tightly to calm them down. LPA tried to interview C1, but C1 did not qualify for an interview. 9 out of 9 staff members stated that when children are misbehaving, they will give them an activity to try to calm them or redirect the children.
During children’s interviews, 5 out of 5 children stated they have not been hugged or grabbed by a staff member.
On 5/14/2025, LPA was able to interview 3 parents, and the 3 parents did not have any concern regarding the allegation.
Based on information gathered from LPA’s interviews with the 9 staff members, 5 children, and 3 parents, the preponderance of evidence has not been met. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations (1) Staff inappropriately disciplined daycare child; therefore, the allegations are UNSUBSTANTIATED.
Exit interview was conducted with the assistant director, Daniela Valladolid. The Notice of Site Visit was posted. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. The director was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
