32 | On 9/23/2024 at 11:32am S1 was observed carrying Child#3 (C3) in the arms and placing C3 that is asleep on the butterfly soft playing structure mat and S1 was then observed walking away. C3 was asleep until the video ends at 11:43am and C3 was not put in the crib. There were 3 staff members presents and 5 infants in the classroom.
Based on the information gathered from the video footage clips the following deficiencies were cited. The facility was not in compliance of the California Code of Regulations, Title 22, Division 12, Sections 101430(a)(3)(E) Infant Care Activities and 101439.1(a)(1)(A) Infant Care Center Sleeping Equipment. Please refer to 809D for details of deficiency.
LPA informed the Director that this report dated 1/13/2025 document a Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed the Director to provide a copy of this licensing report dated 1/13/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview was conducted with Director, Elaina Estrada. The Notice of Site Visit was posted. Director was informed that the Notice of Site Visit must be posted for 30 consecutive days. The Director was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
