On 10/27/21 Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted an investigation regarding the above allegations. LPA met with director, Mirian Yanez. The Covid-19 Emergency Response questionnaire was reviewed and answered by the director. LPA toured the preschool program and took census. There were a total of 15 preschool children with 2 staff on the playground. A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Our office has received an anonymous complaint regarding the above allegations. According to complaint report, it was noticed on 10/14/21 a two year old child had a rash on the child's bottom. It states the area was red and inflamed and also noticed two other rashes in the thigh and buttocks area on 10/18/2021. The report states the child's skin is sensitive to regular wipes. The report sates this incident was never reported to the child's representative. On 10/27/21 LPA interviewed the director and the primary staff person who had the child under care. According to director, they communicate with parents through an application which is called

LifeCubby App. Staff and director send messages through this application to the parents' phones. The director showed LPA that she communicated with the child's representative regarding the diaper rashes on 10/18/21. According child's primary teacher, she had sent messages through the LifeCubby App for diaper needs of the child. However the facility showed one proof of this request for 9/10/21. Staff also stated she had put 3 notes in the child's lunch box for the child's representative that they needed wipes and diaper. Child was transferred from infant room to the preschool in July 21. At the beginning the child had water wipes in the supply basket when child was transferred to the 2 year old room. Staff said child was never provided water wipes since the transitioning in spite of staffs' requests. They only used toilet paper and water on the child. The child was in the learning process and would do it personally. Staff would help the child wiping with the bowel movement. The staff had a difficulty to get the diapers supplies from the child's representative. According to staff the child became fully potty trained for the past month. Child was in underwear. Child had few accidents here and there who was changed when wet. Child another representative borough some diapers which the child did not need because the child was potty trained. According to director and staff, child was never applied any other kind of wipes. They used toilet paper and water which was verbally advised by the parent to be fine. The email communication between the child's representative and facility were reviewed regarding informing the rashes. There are no records to show any communications happened on 10/14/21 as the complaint repot states. However there are communications that the facility informed the child's representative of the rashes on the child's bottom on 10/18/21. Child's teacher stated she observed the rashes on 10/18/21 and let the director know. The director stated she left a phone message for the child's representative and sent an email. The staff and director did not acknowledge observing any rashes prior to 10/18/21. Child's file stated "use water wipes on the child only and no medical allergies". Based on the interviews conducted with the total of 2 staff involved in the incident, obtaining information from email communications, LifeCubby App. and child's file, there is not enough proof or evidence to support the allegations due to discrepancies statements and dates. This agency has investigated the complaint alleging "Provider did not address diapering needs of day care child, and the child's representative was not notified about the rashes on the child"; although the allegations may have happened or are valid, there is not a preponderance of evidence to prove, the alleged violations did or did not occur, therefore the allegations are unsubstantiated. Notice of Site Visit was posted. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. Exit interview was conducted. In the area which was investigated, no deficiency was cited today.
