Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted a follow up investigation regarding the above allegations. This is a follow up for the visit conducted on 2/1/2024. LPA met with director, Saeideh (Fay) Gharavi. LPA observed 3 infants with one staff in the infant playroom 1 and the other staff was in playroom 2. Infant program consists of playroom 1, playroom 2, and napping room. Playroom 1 and Playroom 2 are separated from each other by a baby gate. Playroom 2 has slightly visual from playroom 1.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
1/30/2024 Orange County Childcare Office received a complaint report regarding the above allegations. According to the report, on 1/29/24 at pick up time It was observed through the side glass door 5 children inside the the playroom alone and no one was answering the door for about 10 minutes. Staff # 1 opened

the door and said staff was getting an infant from the napping room. The report stated the napping room is three rooms away from the diapering table. The report also states sometimes one staff member is left alone to care for up to 7 infants and the daily ratios tend to be 6 infants for one teacher during drop off/pick up times. The report also stated staff have left infants in soiled diapers for about one hour resulting infants sustained diaper rashes.

On 2/1/2024 LPA conducted a visit and interviewed 5 staff. LPA interviewed more staff on other date.
A total of 6 staff who work in infant room were interviewed. (Staff # 1, 2, 3, 4, 5, and 6). Children were not interviewed due to their age being young and not being qualified. Total of 8 parents of the infant program were also contacted of whom 6 parents responded. Regarding the allegation of "Staff left infants unsupervised", LPA discussed it with staff # 1. Staff # 1 denied the allegation and stated she was changing a diaper for a child at pick up time and staff # 1 was present in playroom 1 with 4 kids only. Staff # 1 stated she was aware that somebody was knocking on the door. Staff stated child # 1 was on the diaper changing table and staff did not want to leave the child unattended to open the door. Staff stated she opened the door after 2 minutes at pick up time. Staff # 1 stated she had not left infants unsupervised. Staff # 1 stated no child was napping in the napping room at pick up time and staff # 1 was with 4 children on that mentioned date and time. The other staff stated they always stay with children where they are. They do not leave children alone in one room and go to the other room. They always supervise the infants. Parents who were interviewed did not have any concern relevant to the above allegation. LPA reviewed the infant log and did not observe any records of a napping child on that mentioned date and time. The sing in/out for children and staff time cards were also reviewed.

Regarding the allegation of "Staff are not meeting staff-infants rations", LPA interviewed 6 staff who work in the infant program. They stated they are aware of the teacher child ratio and they have not been left alone with more than 4 children. They ask for help if they need to. However there was some discrepancy in staffs' statements. Parents who were interviewed did not acknowledge seeing too many children at drop off or pick up times. They commented that they don't count children at drop off and pick up time. However they confirmed observing one or two staff at drop off and pick up time. LPA also checked the time card of staff for

the week of 1/29/24 and sign in/out sheet for children. LPA checked the staff time cards for signing in and out and checked the number of children signed in and out and found the number of children and number of staff met the teacher child ratio. However there was not precise evidence to prove the location of any staff during their time card hours.

Regarding the allegation of "Staff did not meet infants' diapering needs causing a rash to infants in care", LPA interviewed 6 staff who work in the infant room. They stated they have not observed any diaper rashes on the infants. Two staff stated they have observed slightly rashes after a weekend on some children that tells them they came with rashes from home. Staff stated they use diaper cream on children when changing diaper. They check their diaper as needed to make sure they don't stay in soiled diaper. One staff stated they check every 20 minutes, one staff stated they check every hour, and one staff stated they check children's diaper every 2 hours. They all stated they have a daily log for children that they log it for feeding and changing diaper times and they give the log to parents at the end of the day and they don't keep a copy at school. Parents who were interviewed did not have any concerns related to this allegation.

Based on the interviews conducted with a total of 6 staff working in infant room, and contact of 8 parents of whom 6 responded, and LPA's today's observation and 2/1/2024, there is not enough proof or evidence to support the above allegations occurred or did not occur. This agency has investigated the complaint alleging "Staff left infants unsupervised, staff are not meeting staff-infants ratios, and staff did not meet infants' diapering needs causing a rash to infants in care; although the allegations may have happened or are valid, there is not a preponderance of evidence to prove, the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Notice of Site Visit was posted. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director, Saeideh (Fay) Gharavi was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. No deficiency cited on this inspection date.
