Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 4/23/24, LPA met with Director, Stella Sun Chung and informed the director of the purpose of the visit. The director guided LPA on a tour of the facility and a census was taken. The overall census observed was 3 staff and 20 preschool children.
A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 4/19/24 a complaint was filed with the Licensing office alleging staff yelled at children. Reporting Party (RP) stated RP stated S1 "raise her voice" at the C1 and said "let's go now".

LPA interviewed 6 staff members. Staff #2 (S2) stated S2 has not witnessed S1 yell at children in care. S2 stated, if children are running , S1 will say no running, no thank you, or we use walking feet. Staff go over the day, and rules, sometimes staff need to use a firm voice, especially if a child is going to get hurt or hurt someone else. S3 stated, I will give them one of two choices, for example if a child is running around during lunch, I will say, you can you sit here and eat, or lay on your bed. I will repeat it, and the child sat down and finished their lunch. S5 stated, staff talk to the children, no running walking only. S1 helps S4. S1 helps children to calm down and the children listen. S1 is always good, S1 talks to the children, they listen. S1 reads to the children and sings with them.

LPA Duron interviewed 4 children. All 4 interviewed children did not reveal any staff violating their rights.

LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPAs’ interviews, observation, and the reviewing of records, there is insufficient evidence to corroborate the allegation: Staff yelled at a children. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
