On 11/18/2025, at 8:50am Licensing Program Analyst (LPA), Anna Chan, conducted a follow up investigation to deliver findings regarding the above complaint allegation which was initiated on 09/17/25. LPA met with director, Sun Chung. Census was taken. Overall census observed was 27 preschool children and 4 staff.

A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance.

The Department received a Complaint on 9/9/2025 alleging Staff doesn’t speak to day care child in an appropriate manner.

Reporting Party (RP) stated a staff 6 (S6) yells at daycare children for no reason.

During the investigation, LPA interviewed 7 staff members, 6 children, and 3 parents, obtained documents such as LIC9040, LIC500, Parent Handbook, Incident reports.

During staff interview, 2 of 7 staff stated they have witnessed S6 speak inappropriately to Child 1 (C1) and will snap at C1 and yell madly with raised voice. 2 of 7 staff stated C1’s face shows C1 gets scared at S6.

During children’s interview C1 stated S6 yells mad at them when children do not listen and C1 feel sad when S6 yells. C1 described yelling and showed an opened wide mouth but no sound. Child 3 (C3) stated S6 yells mad and demonstrated using 2 hands facing each other like measuring how mad when children are not listening and C3 feels bad when S6 yells. Child 5 (C5) stated S6 “yells kind of nice” at C1 sometimes because C1 does not listen and says bad words. C5 stated they feel bad when teacher yells.

During parent interviews, 3 out of 3 parents did not disclose information that could support the allegation.

Based on interviews conducted, the preponderance of evidence standard has been met for staff yells at daycare children for no reason, therefore the above allegation is found to be SUBSTANTIATED. See LIC9099D for a Type B deficiency cited. Civil Penalty was being assessed today for repeated violation from 2/28/25.

An exit interview was conducted, and report and deficiency was reviewed and discussed with Director Sun Chung. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Appeal Rights Provided.

The Department received a Complaint on 9/9/2025 alleging (1) Staff are not providing day care child adequate food service (2) Staff are preventing day care child from interacting with other children

During the investigation, LPA interviewed 7 staff members, 6 children, and 3 parents. Obtained documents such as LIC9040, LIC500, Parent Handbook, incident reports.

Regarding allegation (1) Staff are not providing day care child adequate food service

Reporting Party (RP) stated staff give daycare children little to no food and child is always hungry.

During the staff interview, 7 out of 7 staff stated they serve food to children. When children ask for more servings and there is food available, they will provide more food to children.

Director stated the facility receives funding from food program so there is no limit on food serving to children. The food program has a specialist that comes to check on the food portions served to the children and they are very strict.

During children’s interviews, Child 1 (C1) stated they get second serving of food. Child 2 (C2) stated they do not ask for more food. Child 3 (C3) stated they can ask for more food. Child 4 (C4) stated they get a lot of food in school. Child 5 (C5) stated they don’t get food because they came late to school.

Regarding allegation (2) Staff 6 (S6) are preventing day care child from interacting with other children



RP stated staff does not let child play with friends.

During the staff interview, 2 out of 7 staff members stated they have witnessed S6 taking children to the table and let them do another job or activity if children do not listen by not doing the job assigned to them. 3 out of 7 staff members stated when children are rough, they separate them and give them different assignment or job, and they can do free play after. They also verbally redirect children that are having a hard time focusing. 1 out of 7 staff members stated if children have aggressive behavior, they ask the children to be alone for safety reasons or they will send them to the director’s office.

S6 stated the following: If children have a challenging behavior, they redirect them, give them a different job on the table to do on their own for about 3 minutes because these children are 4-5 years old. S6 has a timer for 3 minutes. There are mats the children can work on. They keep themselves inside the mats for a particular Montessori activity. They should stay inside the mats until they finish the task. S6 will prohibit a child from playing with other children only in the situation that the child is hurting their friend or continue repetition of doing not so nice things like not listening or hurting friends. The child will be able to go get a different toy or play with a different friend.

During children’s interviews, 1 out of 6 children disclosed they will sit at the table to draw when they get in trouble.

LPA interviewed 3 parents and none of the parents interviewed disclosed any information that could support the allegations.

Based on record review of the parent handbook, If the behavior of children persist, the child will be removed from the situation and given a brief “time-out” to help think of acceptable ways to express themselves. If it becomes a routine for the child, parent may be asked to attend a conference with the director.

LPA observed children interacting with each other or doing circle time with teachers.

Based on the interviews conducted and record reviews, the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted with Director Sun Chung. Report was reviewed and discussed. The Notice of Site Visit was posted and must remain posted for 30 consecutive days. Appeal Rights were provided.
