Licensing Program Analysts (LPA's) Thompson and Navar conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 3/6/2024. Upon arrival LPA met with Director Christina Naffziger, to deliver complaint findings. Director guided LPA on a tour of the facility. LPA observed a total of 74 Preschool age children with 7 staff.

A review of the Facility Personnel Report Summary indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Orange County Child Care Office received a complaint 2/29/2024 with two allegations (1) Facility does not provide a safe environment for day care children and staff resulting in injuries. (2) Staff are not being allowed to follow reporting requirements.

During the investigation LPA interviewed six staff, interviewed three parents, interviewed three children, reviewed children files, obtained the facility roster, reviewed behavior reports.

Reporting Party (RP) stated child #1 (C1) has injured one child in care. When LPA asked for the name of the injured child, RP could only provide a first name and did not recall when the incident occurred. RP mentioned C1 opening the doors of the classroom and running into the hallway.

On 3/6/2024, LPA interviewed six staff. During the interviews, four staff disclosed child #1 (C1) has left the classroom and entered the hallways of the facility. Staff stated when C1 leaves the classroom, they call for assistants and a staff would intervene. Three staff stated C1 has physically scratched, hit, kicked, and spit on staff, but were not injured. Three staff stated C1 has thrown toys toward children but not at a specific child. A behavior report reviewed reads C1 has hit and kicked both staff and children but didn’t cause any injuries. Two staff stated they are changing the door handles to prevent children from running out of the classroom and into the hallway.

RP stated staff are not being allowed to follow reporting requirements. RP mentioned staff are not allowed to write behavioral reports. During staff interviews, four out of six staff stated if any children show signs of challenging behavior, they are to disclose their concerns with the director or assistant director before decisions are made.

On 3/11/2024 LPA contacted 11 parents via phone call. Three parents were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegations.

On 3/20/2024 LPA Navar conducted three child interviews. Children interviewed all stated they like coming to school and did not disclose information pertaining to the allegation of child injuries.

Based on LPA observation, interviews with staff, parents, and children, there was not enough evidence to substantiate the allegations.

The Orange County Child Care Office has investigated the complaint alleging (1) Facility does not provide a safe environment for day care children and staff resulting in injuries (2) Staff are not being allowed to follow reporting requirements: although the allegations may have happened or are valid, there is not enough preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations is UNSUBSTANTIATED.

In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.



Exit interview conducted and report was reviewed with Director Christina Naffziger.

Notice of Site Visit was provided to Director Christina Naffziger and posted on the door. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights
