Reporting Party (RP) indicated on 8/24/2023, between 10:35 a.m. -10:40 a.m., Child #1 (C1) was left alone inside the classroom.
During the investigation on 1/9/2024, LPA interviewed staff. Staff #1 (S1) stated C1 was inside the classroom with a sub teacher on 8/24/2023. During the time the incident occurred, the sub teacher was transitioning the children to the restroom and thought C1 was following the other children. C1 was left inside the classroom alone for approximately 1 to 2 minutes. Staff #2 (S2) stated not witnessing the incident but later read about it. S2 stated C1 was left alone inside the classroom under 5 minutes but not sure of the actual time. Both S1 and S2 were unsure who found C1 inside the classroom alone.
On 1/10/2024, LPA requested video evidence. Video evidence was unavailable.
On 1/11/2024, LPA conducted parent interviews. LPA called 11 parents and 3 of the parents called were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.
Based on LPA interviews with staff and Reporting party, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency sections 101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation.
LPA Thompson informed Director Michelle Miller that this report dated 1/26/2024 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Thompson informed the Director Michelle Miller to provide a copy of this licensing report dated 1/26/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
