Licensing Program Analyst (LPA) Dean Thompson conducted an unannounced case management incident inspection in response to a self reported Unusual Incident dated 2/21/2024. LPA met with Director Michelle Miller then toured the facility. LPA observed 26 preschool age children with 4 staff.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During the visit, it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios.

On 2/21/2024 a self reported Unusual Incident Report (UIR) was filed with the Licensing Office. Staff #1 (S1) reported on February 20, 2022, at approximately 12:15 PM, child #1 (C1) became separated from the group during the transition from the classroom to the bathroom for approximately 3 minutes. Staff #2 (S2) heard a C1 crying from inside a separate classroom and noticed the child through the glass door. Based on the report submitted, C1 was found in distress and stuck between cots.

On 1/26/2024 the facility received a Type A 101229(a)(1) citation for Providing Care and Supervision. The facility received the citation for a child being left alone inside a classroom for approximately 1 to 2 minutes. LPA requested video footage for that incident and was told the company the facility works with only provides access for 5 days to their camera review team.

LPA Thompson informed the Director Michelle Miller to provide a copy of licensing report dated 1/26/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA observed child #2 (C2) did not have a written statement or LIC 9924 inside their file stating the parents were informed of the incident dated 1/26/2024.

On 2/20/2024, director Michelle Miller emailed LPA at 5:56 PM informing LPA of the incident that occurred earlier in the day on 2/20/2024. Director stated she would submit a UIR the following day on 2/21/2024. On 2/20/2024 at 6:20 p.m., LPA contacted the district manager and requested to review video footage for the incident dated 2/20/2024 since LPA was previously told video footage can be accessed for 5 days. LPA was told by the district manager that they would be happy to show the footage and that the footage would have to be viewed at the facility with director Michelle and district manger via teams.

The district manager agreed to an appointment on February 27, 2024 at 8:30 a.m so that LPA could review the video footage. LPA arrived to the facility at 8:00 a.m. on 2/27/2024 and was told by director Michelle that the district manager was having trouble finding the video footage. At approximately 8:35 a.m., LPA was told by the district manager the video footage could not be found.

On 2/27/2024, LPA interviewed two staff. S1 stated based on video footage, C1 was left alone inside the classroom for approximately 3 minutes while the teacher of C1 and other children transitioned to the restroom. S2 stated after hearing crying for approximately 45 seconds, S2 observed C1 crying inside a separate classroom as C1 was left alone stuck between cots. S2 stated not knowing the exact time C1 was left alone but from reports it was approximately 3 minutes. Although the district manager scheduled a time and date with LPA to view footage, LPA couldn't determine how long C1 was left unsupervised for due to video footage not being available.

Based on the UIR submitted to the Orange County Regional Office, interviews conducted on 2/27/2024 and staff stating C1 was left alone without any adult supervision. The following violation 101229 (a)(1) Responsibility for providing care and supervision was revealed today and is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1. Please see the attached LIC 809D.

Also, LPA Thompson informed Director Michelle Miller to provide a copy of this licensing report dated 2/27/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Director Michelle Miller. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.



Appeal Rights and deficiencies were discussed. The director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
