Licensing Program Analyst (LPA) Dean Thompson conducted an unannounced case management incident inspection in response to a self-report Unusual Incident dated 3/18/2024. LPA met with Director Michelle Miller. LPA observed 32 preschool age children along with 5 staff.

A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 3/18/2024 a self reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported on 3/15/2024, children were outside playing and child #1 (C1) had pulled up her dress to show her bottom and child #2 (C2) pulled down her underwear. C1 walked over to staff #1 (S1) and reported the incident. S1 reported the incident to staff #3 (S3). S3 stated she is unaware if both staff on the play yard witnessed the incident. S3 stated she asked C1 what happened and C1 said she just wanted to show her bottom.

During staff interviews on 3/26/2024, it was determine there were 2 staff on the play yard with 20 children when the incident occurred. Both staff #1 (S1) and staff #2 (S2) stated they did not see the incident when it occurred. S1 stated the incident occurred near the fence and she was positioned near the sand box with other children. Director was reminded when children are on the play yard, children should be visible at all times.

In the areas that were evaluated, one Type A deficiency is being cited of the California Code of Regulations, Title 22, Division 12 at the time of the visit. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency sections 101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation.

DIrector stated they have a staff meeting coming up. Director also stated she has talk to staff about spreading out and making sure children are visible at all times.

Based on the UIR submiteed and staff interviews, staff stating they did not see when the incident occured and was only made aware of the incident when C1 informed S1.This is an immediate risk to the health and safety of children in care.

LPA Thompson informed Director Michelle Miller that this report dated 3/26/2024 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Thompson informed the Director Michelle Miller to provide a copy of this licensing report dated 3/26/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the Director Michelle Miller. Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100.



Appeal Rights and deficiencies were discussed. The Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
