Reporting Party (RP) mentioned a child was inside the kitchen and inside the hallways unsupervised.
Child was inside the kitchen and inside the hallways unsupervised. During the investigation on 7/26//2024, LPA interviewed three staff. Two staff stated child #1 (C1) walked away from his group and went into the hallway. Two staff stated once C1 entered the hallway, C1 was not visible and was unsure if C1 went into the kitchen or not. One staff mentioned as they were inside the restroom with other children, C1 walked away from the group and the staff not have visual observation on C1. The staff mentioned not seeing C1 enter the kitchen but stated they later heard C1 ran into the kitchen by other staff members. LPA measured the distance from the restroom C1 walked away from to the kitchen and the distance is approximately 75 feet. All three staff interviewed stated this was not the first time C1 has walked away from their group.
LPA conducted parent interviews. LPA called 11 parents and 3 of the parents called were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.
Children were not interviewed due to age and being nonverbal.
Based on staff stating they did not have visual observation on C1 after C1 entered the hallway and couldn’t determine if C1 entered the kitchen or not; the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency sections 101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation.
