Licensing Program Analyst (LPA) Thompson conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 7/26/2024. Upon arrival LPA met with Director Ashley Neitzke to deliver complaint findings. LPA toured the facility and observed a total of 50 preschool age children along with 6 staff during nap time.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

On 7/26/2024 the Orange County Child Care Office received a complaint with one allegation (1) Staff left a child unsupervised.

Reporting Party (RP) mentioned a child was inside the kitchen and inside the hallways unsupervised.

Child was inside the kitchen and inside the hallways unsupervised. During the investigation on 7/26//2024, LPA interviewed three staff. Two staff stated child #1 (C1) walked away from his group and went into the hallway. Two staff stated once C1 entered the hallway, C1 was not visible and was unsure if C1 went into the kitchen or not. One staff mentioned as they were inside the restroom with other children, C1 walked away from the group and the staff not have visual observation on C1. The staff mentioned not seeing C1 enter the kitchen but stated they later heard C1 ran into the kitchen by other staff members. LPA measured the distance from the restroom C1 walked away from to the kitchen and the distance is approximately 75 feet. All three staff interviewed stated this was not the first time C1 has walked away from their group.

LPA conducted parent interviews. LPA called 11 parents and 3 of the parents called were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.

Children were not interviewed due to age and being nonverbal.

Based on staff stating they did not have visual observation on C1 after C1 entered the hallway and couldn’t determine if C1 entered the kitchen or not; the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency sections 101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation.

LPA Thompson informed Director Ashley Neitzke that this report dated 8/15/2024 document(s) one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Thompson informed the Director Ashley Neitzke to provide a copy of this licensing report dated 8/15/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.


Exit interview conducted and report was reviewed with the Director Ashley Neitzke. Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100.

Appeal Rights and deficiencies were discussed. The Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Staff did not allow child in care to use the bathroom resulting in the child urinating on themselves. During the investigation on 7/26/2024, LPA interviewed three staff. All staff interviewed stated they recalled the incident when C1 did have an accident. Staff stated another staff was assisting a teacher taking children to the restroom and while C1 was waiting for the staff and a small group of children to return from the restroom, C1 urinated on themselves. Staff stated they took the other children to the restroom first because C1 required closer supervision because C1 was known to walk away from their group.

LPA conducted parent interviews. LPA called 11 parents and 3 of the parents called were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.

Children were not interviewed due to age and being nonverbal.

Based LPA observation, interviews with staff and parents, there was not enough evidence to substantiate the allegation.



The Orange County Child Care Office has investigated the complaint alleging Staff did not allow a child in care to use the bathroom: although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.


In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.

Notice of Site Visit was provided to Director Michelle Miller and posted on the door. The notice of site visit must be posted for 30 consecutive days.
