Licensing Program Analyst (LPA) Dean Thompson conducted a case management inspection, in conjunction with another inspection at the facility. Upon arrival at 8:03 am, LPA met with infant staff #1 (S1). Census was taken inside the infant classroom. LPA observed a total of 6 infants with S1 inside the Infant classroom. Per Title 22, Division 12 Section 101416.5(b) Staff-Infant Ratio, there shall be a ratio of one teacher for every four infants in attendance. Assistant Director Athinia Huber (S2) arrived at approximately 8:15 am. LPA met with Director Laura Johnson at 8:45 am.

A review of staff records on this date indicates that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

While retrieving the names of the children inside the Infant classroom, LPA observed S2 direct S3 from the kitchen into the Infant classroom to help with staffing ratio. During file reviews, it was determine S3 was not hired at the center as a teacher or aide and did not have qualifications to be inside the infant classroom caring for children in care. 101416.2 Infant Care Teacher Qualifications and Duties (b) Prior to employment, an infant care teacher shall have completed, with passing grades, at least three post secondary semesters or equivalent quarter units in early childhood education or child development, and three post secondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university.

Based on LPA's observations of one (1) staff supervising six (6) infant children, the facility is in violation and will be cited for one Type A 101416.5(b) Staff-Infant Ratio and one Type B 101416.2 Infant Care Teacher Qualifications and Duties. This is an immediate health and safety and personal rights risk to the children in care. See deficiency observed and cited on LIC 809D.

LPA Thompson informed Director Laura Johnson that this report dated 5/16/2023 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Thompson informed Director Laura Johnson to provide a copy of this licensing report dated 5/16/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Director Laura Johnson. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.



Appeal Rights and deficiencies were explained. Director Laura Johnson was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
