Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted a follow up investigation regarding the above allegations. This is a follow up for the visit conducted on 9/24/2024. LPA met with director, Jamie Luu and assistant director, Dominique Coccio. Today, there were a total of 58 children with 6 staff in the classrooms and on the playground. Rooms 8, 9, 10, 16 were toured.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 9/19/2024, the Orange County Childcare Office received a complaint alleging 1) staff speaks inappropriately while in the presence of children, 2) Staff do not ensure that children's personal care needs are met, 3) Staff yelled at daycare children, 4) Staff grab a child by the arm, and 5). Staff degrade parents and children by using loud voice in presence of children. Reporting Party (RP) stated it was observed a staff grabbed a child by their arm and yell at the child while they were on the playground (names and date unknown for R/P). R/P continued staff degrade parents and children by using loud voice to parents

while children present. (dates and names unknown). RP indicated that staff do not meet children's personal care needs because the staff do not take the children to the restroom every thirty minutes resulting children having potty accidents, developing rashes.
The investigation involved interviews with 12 staff members, 9 children, and 2 parents to assess allegations concerning staff behavior and childcare practices.
• Staff Member S1 reported positive relationships with both colleagues and facility clients. S1 stated they have never spoken inappropriately to any adults or raised their voice, emphasizing their soft-spoken nature. Although S1 received information that Adult # 1(A1) witnessing two staff members yelling at each other on the playground, S1 did not personally observe any inappropriate behavior. Staff are diligent in changing children’s diapers as needed, ensuring children do not remain in soiled diapers.
• Staff Member S2 mentioned an incident on August 30, 2024, reported where adult # 1 alleged staff were yelling at each other on the playground. However, no names were confirmed. S2 did not witness any such behavior and confirmed that staff change diapers every two hours or as necessary.
• Staff Member S3 echoed similar observations, stating no instances of staff yelling or grabbing children were witnessed. S3 noted that conversations with S4 on the playground were cold but not inappropriate. Diaper changes are logged, and staff are attentive to the children’s needs.
• Staff Member S4 was unavailable for an interview.
• Staff Member S5 also denied witnessing any inappropriate behavior stating no instances of staff yelling or grabbing children were witnessed and explained that staff occasionally hold children gently to prevent falls. Diaper changes follow a strict schedule, and no rashes have been observed.
• Staff Member S6 stated they have never seen staff yelling, grabbing, or acting inappropriately. They check children’s diapers every one to two hours and apply cream during changes to prevent rashes.
• Staff Member S7 confirmed that staff do not speak inappropriately in front of children and stating no instances of staff yelling or grabbing children were witnessed and noted that they are respectful to all. Diapers are changed regularly, and children are quickly dressed after any potty-training accidents.
• Staff Member S8 acknowledged that they may have raised their voice to get children’s attention but clarified this was not yelling. They observed no inappropriate interactions among staff or with children. S8 indicated no potty accidents have been observed.
• Staff Member S9 did not observe any inappropriate conduct and stating no instances of staff yelling or grabbing children were witnessed and confirmed that staff promptly change children after accidents if any.

• Staff Member S10 stated that staff use a firm voice to address inappropriate behavior but do not yell and noted did not witness staff to yell at children, grab them by the arm, or staff talk inappropriately in front of children. Staff do not use loud voice to talk to anybody at school. Diapers are changed five times a day, and they ensure children do not develop rashes.
• Staff Member S11 did not observe any inappropriate conduct regarding children and adults, noted that children are regularly checked for diaper changes and have not reported any rashes at school.
• Staff Member S12 indicated no instances of inappropriate staff behavior were observed. S12 noted children are potty trained and did not observe children with potty accidents. Children go to bathroom when they need to.
• Staff Member S13 stated they did not witness staff yelling but noted a specific incident between S3 and S4 that was perceived as rude, noting not observing any inappropriate conduct regarding children and adults. Children are potty trained and not observed any potty accidents. Children are taken to bathroom as needed.
Interviews with 9 older children revealed positive feedback regarding staff interactions. The children expressed love and respect for the staff, stating that staff do not yell or behave inappropriately. They confirmed that they go to the bathroom when needed and have not experienced potty accidents.
Of the ten parents contacted, two responded, both expressing no concerns regarding the allegations.
Based on the interviews with 12 staff, 9 children, contacting 10 parents, and reviewing relevant documents, there is not enough proof or evidence to support the above allegations occurred or did not occur. This agency has investigated the complaint alleging 1) staff speaks inappropriately while in the presence of children, 2) Staff do not ensure that children's personal care needs are met, 3) Staff yelled at daycare children, 4) Staff grab a child by the arm, and 5). Staff degrade parents and children by using loud voice in presence of children.”; although the allegations may have happened or are valid, there is not a preponderance of evidence to prove, the alleged violation did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Notice of Site Visit was posted. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100.
The director, Jamie Luu and the assistant director, Dominique Coccio were provided a copy of their appeal rights (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights.
