Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted an announced on site pre-licensing inspection at this childcare center for the purpose of operating a school age program. LPA met with the director, Esmeralda Gonzalez. LPA was given a tour with director of the school classrooms. This school age program is located at OCCA Charter School.

The applicant has requested to provide care and supervision for 90 school age children ages from Transitional Kindergarten to 13 years old, Monday through Friday 7:00am to 8:15 am for before school and 1:00 to 6:00 pm for after school and Summer Break and Winter Break form 8:00 am to 4:00 pm.

LPA observed the facility following CDC and Dept of Public Health Guidelines. Due to COVID Pandemic parents shall be encouraged to follow the CDC and COVID requirements.

A review of the Facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Parents sign in and out their children manually. The staff sign the children out and sign them back in for before and after school schedules. Staff sign in and out the school age children when staff drop them off and pick them up from school ground. The younger children are dropped off and picked up by staff and older children arrive on their own on the school ground. Upon arrival each child has an health evaluation along with hand washing before they participate in the activities.

Isolation area is the office, located at the entrance of the facility and there is an additional cot with bedding for the sick child in the Director's office. The bathroom for sick children is the staff bathroom.

LPA discussed the posting requirements including, but limited to, the following:
· Facility License in public area (101160)
· Emergency Disaster Plan (LIC 610)
· Earthquake Preparedness Check List (LIC 9148)
· Parents’ Rights Poster (PUB 393)
· Personal Rights (LIC 613A)
· Notice of Site Visit (LIC 9213) and Type A deficiencies / Plan of Corrections of Type A deficiencies
· Granted Waivers (available for review)
· Child Car Seat Law (PUB 269) & · COVID Posters.

The following was observed in the classrooms. (Total of 8 classrooms B2, C2, E1, E5, G1, G2, G4, and H3). LPA observed elementary children from this Charter School were present in the classrooms.

· Classrooms are adequately equipped with age and size appropriate furniture and equipment
· Drinking water is available inside through personalized water bottles and water dispenser.
· Sign in/Sign out procedure was reviewed.
· Facility has in-built smoke detectors & carbon monoxide detectors on the ceiling. There is fire extinguisher mounted that meets statutory requirements.
· Cubbies available for storage of individual child’s personal belongings by hanging their back packs.
· Facility provide morning and afternoon snack and lunch will also be provided on full days..
Rooms are well lighted with proper ventilation.
Medications are stored in the locked box if any.
First Aid kit and Emergency kit is present.

This school age childcare program meets the requirements of Health and Safety Code Section 1596.806 and is exempt from square footage requirements for indoor, and outdoor activity space. The facility is also is exempt from fencing, outdoor activity space, toilet, and isolation space requirements.
Fire clearance received from Orange County Fire Authority approving the requested capacity of 90 school age children. The capacity per room for a school age childcare program that meets the requirements of Health and Safety Code Section 1596.806 shall not exceed the number of children for which a room of this size is commonly approved for school use during the school day. According to director, Esmeralda Gonzalez each room is occupied by 20 students on school days. There are a total of 8 classrooms.

§1596.806: Exemption from square footage, toilet, isolation space, outdoor activity space, and fencing requirements
(a) A room used as a classroom by a school-age childcare program shall not be required to meet the square footage or toilet requirements for child day-care centers if the program is operated on either of the following:
(1) A functioning school site in the same facilities that have housed school children during the day, before or after school hours, or before and after school hours.
(2) A functioning school site in facilities certified as usable as a classroom for instruction. A building owned by a school district, the state, or the school age child care program may meet the certification requirement if either of the following is provided to the department:
(A) Evidence that the building was approved as a classroom by the Division of the State Architect.
(B) A certification statement signed by the superintendent of the schools, or their designee, in the district where the school age childcare program is located, that the classroom building is of sufficient size to accommodate public instruction. The school district may make this certification regardless of the ownership of the classroom.
(b) School grounds, other than rooms used as classrooms, used by a school-age childcare program operated on a functioning school site pursuant to either paragraph (1) or (2) of subdivision (a) shall be exempt from all of the following requirements imposed by the department on child day-care facilities:.
Requirements to have exclusive use of the outdoor activity space or exclusive use of children’s rest rooms

also used by students located on school grounds.
(c) The exemptions pursuant to subdivisions (a) and (b) shall continue during school vacation and intercession periods.
(d) (1) For purposes of this section, “school-age childcare program” means a program for children who are currently enrolled in a school, including transitional kindergarten, as defined in Section 48000 of the Education Code, or are dependent children living within the same household as a child attending a school, operated by an entity that contracts with the school to provide staff and program.
(2) Notwithstanding the rule making provisions of the Administrative Procedure Act (Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code), the department may implement and administer the changes made by the act that added this paragraph through letters or similar written instructions that shall have the same force and effect as regulations until regulations are adopted.
The following was observed:
· Playground is fully enclosed by an appropriate fencing
· Outdoor activity space is supplied with age and size appropriate equipment, outdoor activity toys,
There are climbing structure with slide on the outdoor space with adequate amount of cushioning such as sand and wood chips.
Shade is provided by trees, and awnings.
Drinking water is provided by children's own water bottles and water dispenser.
The director, Esmeralda Gonzalez is current on the required Immunization/ Pediatric CPR/ First training and has provided the completion certificate for the Preventive Health training (Nutrition and Lead component) and Mandated Child abuse reporting training.
Following items were discussed at the time of Exit interview.
Criminal Record Statement :The Director, Esmeralda Gonzalez was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
