Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted a case management inspection of the facility for the purpose of the facility moving to a temporary portable childcare located in the parking lot in front of the old childcare facility with a reduced capacity due to some unfortunate catastrophe happened in the shopping center.

LPA met with the Applicants Mathiou and Amber Zaky. LPA was given a tour by the applicants of the entire new portable.
The applicants have requested to provide care and supervision for 36 preschool children ages 2 to 6 years old, Monday through Friday 7:00 AM to 6.00 PM.

Parents sign in and out electronically at the entrance of the portable. Upon arrival each child has an health evaluation along with hand washing before they participate in the activities.
No children are present today.

A review of the Facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
The facility provides morning and afternoon snacks and lunch to children.
All areas identified on the Facility Sketch were inspected. If children become ill during the day, they will rest in the corner of the portable with a standing divider to separate the area from other children. This area is equipped with a cot and separate bedding and staff bathroom will be used if needed until sick children are picked up.

Following was observed in the portable:
Age appropriate furniture and activities including educational, arts & crafts items.
Room is well ventilated with proper lighting and shade. There is a working carbon monoxide available in this portable.
The indoor measurement of the portable is as below:
Portable is 1234.10 square feet divided by 35 square feet = 35.26 (35 children)

Total of Toilets: 2 X 15= 30 children
Sinks: 3 X 15 = 45 children.
The bathroom is located inside the portable. There is one sink inside the childcare area.
Playground measurement: Outdoor activity space is 3290 square feet divided by 75 = 43.87
(44 children). The playground is located at the old childcare facility. Children will be walked from the portable to and from the playground by staff. The portable is 74 feet away from the playground. A written plan will be submitted of how children will be escorted to and from the playground.
The following was observed for outdoor space:
· The Playground is fully enclosed by appropriate fencing. There is a gate opening to the parking lot which is locked by a padlock and key. According to applicants, the gate is not opening and closing during day care hours and it is always locked with a key which is kept separately. There are two other gates on the playground that alarm devices are installed on them. LPA discussed the supervision and staff stationing on the playground to watch out for these exist gates.
· Outdoor activity space is supplied with age and size appropriate equipment, outdoor activity toys,
· There are climbing structure on the playground which is equipped with adequate cushioning materials. Shade is provided by wooden structure.
Drinking water is provided by children's own water bottles, and filter water.
Fire clearance received from Orange County Fire Authority approving the requested capacity of 36 preschool children. However, there is only 2 toilets for children's use in this portable that limits the total capacity to 30 children.

LPA gave a copy of the LIC 311A, Records to Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted. The new director is Cherish Guardado. The director's Immunization, Mandated Reporter Training, Health and Safety Training are current. Her CPR and 1st aid is EMSA approved and expires 10/23/2023.

The applicants, Mathiou and Amber Zaky were reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Care option to receive email communication. Exit interview conducted and report was reviewed with the applicants, Mathiou and Amber Zaky.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Based on today’s measurements, the sinks and toilets availability, the request of the facility for moving to a new portable temporarily for 30 children will be final reviewed and discussed with management in the Regional Office and after receiving the following corrections. The facility will be notified if any additional information is required. Please send the following corrections within 30 days of today's date.



1- A complete director's packet for the new director, Cherish Guardado.
2- Written plan to be sent to our office of the walking procedure to and from the playground.
