On 06/21/2024, Licensing Program Analyst (LPA) Romy Castanon made an unannounced complaint investigation visit that was received at the Orange County Regional Child Care Program Office. LPA met with Office Administrator Binbin “Vicky” Zhao and explained the reason for today’s visit. Observed at the time of the visit was a total of seven (7) infants and three (3) staff.
A review of the Facility Personnel Report Summary on 06/21/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 03/25/2024, the Regional Office received a complaint report alleging staff are operating out of ratio. Reporting Party (RP) stated during a visit to the facility, RP was informed the infant room ratio was one (1) teacher to four (4) infants. RP stated they observed seven (7) infants with one staff member in the infant room. RP stated Staff #1 (S1) informed them the other staff were on their lunch breaks. Reporting Party did not provide contact information so no further details could be obtained. (Continue to page 2)

LPA conducted a visit on 03/29/2024 and interviewed two (2) staff. During the interview with staff, 2 out of 2 staff stated their infant classroom has had incidents of being out of ratio. Two (2) out of 2 staff stated ratio issues began just recently due to staffing shortage. Two (2) out of 2 staff stated the infant classroom usually has eight (8) children for the two (2) staff members but sometimes all nine (9) enrolled children attend.

LPA reviewed all staff time sheets and children’s attendance sheets for the week of 02/26/2024-03/01/2024. 3 out of 6 staff are assigned to the infant classroom, but two (2) of those staff also work in the preschool classes when infant license ratios are low.

On 06/04/2024, LPA interviewed three (3) parents, but no disclosures were made regarding complaint allegation. Children were not interviewed due to age and language development.

Based on LPA interviews and record review, the preponderance of evidence standard has been met, therefore the above allegation staff are operating out of ratio is substantiated. California Code of Regulations, Title 22, Division 12, 101416.5 Staff-Infant Ratio is being cited on the attached LIC9099D.

Exit interview was conducted with Office Administrator Binbin “Vicky” Zhao. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Upon receipt, Office Administrator Binbin “Vicky” Zhao shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file.

Office Admin Vicky Zhao stated the infant room is now fully staffed with 2 fully qulaified teachers and one aid that are scheduled full time. In case of a staff absence, there are at least two additional fully qulaified staff on site. Admin stated they will create an action plan to ensure the facility does not operate out of ratio by POC date.

Based on LPA's interviews and record review the infant classroom has had many incidents of being out of ratio when all enrolled children attend and ongoing staffing issues. This poses an immediate risk to the health, safety or personal rights to persons in care.
