On 06/21/2024, Licensing Program Analyst (LPA) Romy Castanon made an unannounced complaint investigation visit that was received at the Orange County Regional Child Care Program Office. LPA met with Office Administrator Binbin “Vicky” Zhao and explained the reason for today’s visit. Observed at the time of the visit was a total of seven (7) infants and three (3) staff.
A review of the Facility Personnel Report Summary on 06/21/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 04/08/2024, the Regional Office received a complaint report alleging unqualified staff was left alone caring and supervising infants in care. The complaint stated Staff #1 (S1) was left alone in the classroom with infants on 4/05/2024. There was no contact information provided so LPA was unable to contact RP for details. During LPA’s initial visit on 04/10/2024, LPA interviewed two (2) staff members. During the interview, Staff #1 (S1) stated on 04/05/2024, Staff #3 (S3) and S1 cared for seven (7) infants throughout the day. S1 stated Staff #2 (S2) helped during shift breaks. S1 stated S3 left at 4:00pm and S1 was left alone in the infant classroom to care for four (4) infants. S1 stated there was no extra staff available to cover S3’s absence. S1 stated the last infant was picked up at 5:45pm. During interview with Staff #2 (S2), S2 disclosed they help cover breaks in the infant classroom when their preschool class is napping. S2 stated they do not return to assist in the infant room as they have their own classroom to supervise.

During visit on 04/10/2024, LPA reviewed staff files for four (4) staff. Facility Representative was unable to produce copies of S1’s school transcripts to verify if they have earned any early childhood education units. LPA determined that S1 is not qualified and was alone caring for 4 infants from 4:00pm-5:45pm on 04/05/2024.

LPA interviewed 3 out of 4 parents but no disclosures were made regarding allegation of complaint. Children were not interviewed due to age and language development.

Based on LPA’s record review and interviews with two (2) staff, the preponderance of evidence standard has been met, therefore the above allegation there is unqualified staff was left alone caring and supervising infants in care is substantiated. California Code of Regulations, Title 22, Division 12, 101416.2 Infant Care Teacher Qualifications and Duties is being cited on the attached LIC9099D.

Exit interview was conducted with Office Administrator Binbin “Vicky” Zhao. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Office Admin Vicky Zhao stated the staff schedules have been modified to ensure that there is a qualified staff member during all shifts of infant room aid staff. Admin will provide LPA with shift schedules with updated changes by POC date.

Based on LPA’s record review and interviews, infant classroom aid was left alone caring for four (4) infants from 4:00pm-5:45pm on 04/05/2024. This poses an immediate health, safety or personal rights risk to persons in care.
