32 | LPA Observations:
On 07/09/24, during the facility walk through, LPA observed 5 infant children and 1 fully qualified teacher at 8:45am. At 8:50am 2 more children were dropped off and still with one fully qualified teacher. LPA asked a parent who was dropping off a child to stay with the child until another staff arrives. At 9:00am, Staff 2 (S2) arrived and there were 7 infant children and 2 fully qualified teacher.
LPA interviews:
On 07/09/24, LPA interviewed 2 staff, Staff #1 (S1) stated that the facility is sometimes out of ratio. S1 stated they are aware that infant ratio is 4:1 staff. Staff #5 (S5) stated 2 other staff members called off this morning that is why the facility was out of ratio. S5 stated the facility is aware of the number of children in attendance daily.
Based on LPA observation, inspection and interviews conducted with 2 staff, it was determined the facility has operated out of ratio. Therefore, the preponderance of evidence standard has been met, the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101416.5(b) Staff-Infant Ratio is being cited on the attached LIC 9099D. This is a repeat violation cited on 06/21/24. Civil Penalty assessed.
LPA Chan informed Office Administrator Binbin "Vicky" Zhao, that this report dated 07/09/2024 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed admin to provide a copy of this licensing report dated 07/09/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted, and the report and deficiency were reviewed with Office Administrator Binbin "Vicky" Zhao. Notice of Site Visit was posted during the visit. The director was informed that the notice of the site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.
Appeal Rights was explained. The Licensee was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. (End of Report) |
