Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted an unannounced on site pre-licensing inspection at this childcare center for the purpose of change of ownership from license number 304370212. LPA met with the director, Julie Bergman who gave LPA a tour of the entire facility.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The applicant has requested to provide care and supervision to 110 preschool children ages 2 to 6 years old in 6 rooms (Rooms 2, 3, 4, 5, 6, and 7), Monday to Friday from 7:30 am to 5:30 pm. Room # 1 belongs to Kindergarten children with private school affidavit which is licensed under Department of Education. Room # 1 is not sharing the restroom with preschool children. There is one restroom designated for children from private kindergarten.
Parents sign in and out electronically in the lobby at the entrance of the building. Isolation area is the corner of the lobby by the front desk under a staff's supervision. The area is equipped with a mat and beddings. The staff bathroom will be used if needed for the sick child until child is picked up.

LPA discussed the posting requirements including, but limited to, the following:

The following was observed in six classrooms:
Age appropriate furniture and equipment’s
Toys, tactile equipment's
Rooms are well lighted with ventilation.
There is sufficient open area for the child to move.
Storage cubbies are arranged to store personal belongings
Flooring is wood.
Morning and afternoon snacks, and lunches are provided by the parents.
Water is provided in the children's water containers with their names on them. The facility refills the water for children if needed.
Children sleep on mats. Beddings are provided by the parents and sent home to be washed on a weekly basis.
LPA measured the assigned rooms for preschool:
Room # 2 is: 515.76 square feet (There is an electrical panel room in this room that shall be locked at all times).
Room # 3 is: 959.48 square feet
Room # 4 is:722.06 square feet
Room # 5 is: 913.48 square feet
Room # 6 is: 1002.64 square feet (This room leads to 2nd floor which the stairs are barricaded)
Room # 7 is: 640.76 square feet (This room has a door leading to street and has a panic alarm on the door).
Total indoor space measurements for six classrooms are: 4756.19 square feet divided by 35 square feet = 135.89 (136 children).

Total sinks: 10 X 15= 150 children
Total toilets:10 X 15 = 150 children
Total measurement for the outdoor space:
Playground is 7074.73 square feet divided by 75 square feet =94.33 (94 children)
Gym open area: 1168.80 square feet divided by 75 square feet = 15.58 (16 children)
Total measurement of the outdoor space including the gym open area is 8243.53 divided by 75 square feet =109.91 (110 children). There is a gate leading to parking lot on the playground which is equipped with alarm system.
Outdoor space for preschool children is fully enclosed by an appropriate fencing, Outdoor activity space is supplied with age and size appropriate equipment, and outdoor activity toys. The area is covered with adequate of cushioning. There is a high play structure on the outdoor activity space for preschool children with slide. There are adequate cushioning (foam) around and under the falling zones. Shade is provided by several awnings.
Fire clearance received from Orange County Fire Authority approving the requested capacity of 110 preschool children.
The director, Julie Bergman is current on the required Immunization/Mandated Child abuse reporting training. Her EMSA Pediatric CPR/ First training certificate expires 9/1/2024. She also has EMSA approved Preventive Health and Safety training with lead poisoning and nutrition training.
Following items were discussed at the time of Exit interview.
The facility representative, Julie Bergman was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPA reviewed the LIC 311A, Records to Be Maintained at the Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

To receive important license related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication. The facility representative was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Based on today’s indoor and outdoor measurements, the sinks and toilets availability, the request of the facility for 110 preschool children ages 2 to 6 years old in rooms 2, 3, 4, 5, 6, and 7 will be final reviewed and discussed with management in the Regional Office and after receiving the following corrections. The facility will be notified if any additional information is required. Exit interview conducted and report was reviewed with the director, Julie Bergman.

1- Remove the mirror on the wall in room 7 or make it safe. The edges of the mirror are sharp.
2- Waiver request for sharing playground with private kindergarten and using additional indoor space as outdoor space due to lack of adequate measurement of the playground for the requested total capacity. Please send waiver request letters including the outdoor scheduling, LIC 500, LIC 999, photo of the playground and the gym.
