On 11/15/2024, LPA conducted parent interviews. LPA called 8 parents and 3 of the parents called were able to be interviewed. All parents interviewed did not divulge any information pertaining to the allegation or express any concerns regarding care of the children.
During todays visit 12/03/2024 LPA reviewed video footage incident with Director Kenya dated 9/09/2024 at 1:20PM and discussed personal rights of children.
Based on LPA’s observations, interviews with reporting party, staff, children, and parents, and reviewing video footage, the preponderance of evidence has been met; therefore, the allegation of Staff handled day-care child in a rough manner is Substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223(a)(3), Personal Rights Type A violation is being cited. See LIC9099D for deficiency cited.
Exit interview conducted and report was reviewed with Director Kenya Meneses. The director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00. Appeal Rights and deficiencies were discussed. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
LPA Karen Navar informed Director Kenya Meneses that this report 12/03/2024, documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA informed Director to provide a copy of this licensing report dated 12/03/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
