32 | Uncleared adult supervises children in care
During the investigation, LPA Habtom conducted interviews and observation regarding the allegation an uncleared adult supervises children in care. The reporting party stated a staff member was left to supervise children with no fingerprint clearance. Staff, children, parent and the owner interviews disclosed that the person in question was not a teacher. The owner states the person in question was hired as a custodian after school hours when children were not present at the facility. An additional interview and documents collected revealed that the person named in the complaint was employed at the facility. Based on a combination of interviews and documents collected, LPA was able to determine that the person in question was employed but unable to determine the capacity in which the person in the complaint held therefore the allegation uncleared adult supervises children in care is to be UNSUBSTANTIATED. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the allegations did or did not occur.
Staff did not report suspected abuse to authorized agency
During the investigation, LPA Habtom conducted interviews and observation regarding the allegation that staff did not report suspected abuse to authorized agency. The reporting party stated the facility staff failed to report marks on a child to the proper agency. LPA reviewed children files and roster but could not locate the child named in the complaint. A staff interview revealed that there were two children who attended the program 6 years ago with the same name as the child named in the complaint. LPA could not validate or invalidate that the incident did or did not occur due to the limited information therefore the allegation staff did not report suspected abuse to authorized agency to be UNSUBSTANTIATED. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the allegations did or did not occur.
A notice of site visit was provided to be posted for 30 days. This report was reviewed with director, Patricia Perez. Appeal rights provided.
