At 11:05am on 8/20/2024, Licensing Program Analysts (LPAs) Matthew Gallo and Fabian Schwartz met with facility representative Paolo Sarmiento the purpose of an unannounced/annual required inspection. Today's total census included 19 preschool children supervised by 4 staff.

Upon arrival, LPAs were led to the outdoor play area, where 19 children were supervised by 3 staff. Through interview and record review, LPAs determined that one of the staff at that time was a teacher and the other two were aides.

Facility hours of operation are 6:30 a.m. to 6:00 p.m., Monday thru Friday. Facility offers transportation services.

LPA toured the building including all activity and classroom spaces, restrooms, food service and outdoor play areas. All necessary postings were observed. Director stated there were no poisons or firearms on the premises, and LPA did not observe any bodies of water. All toxic and hazardous items were inaccessible to children. Functional carbon monoxide detector and smoke detector were present. Furniture and equipment were in good condition and floors were clean throughout the facility. Playground equipment and surfaces were free of loose or sharp parts, and the areas underneath or around climbing equipment were sufficiently cushioned with wood chips. Program provides lunch and AM and PM snacks, and menus were posted in visible sight. The food preparation space was free of litter and all food was protected against contamination. Storage containers with solid waste had tight-fitting covers. Drinking water was readily available to children both indoors and outdoors via labeled water bottles. Sufficient napping equipment was present. The facility utilizes an electronic sign-in/sign-out system. LPA observed an inhaler stored in the office cabinet that does not include a container with a prescription label featuring physician instructions.

6 children's files were reviewed. All of the files reviewed lacked signed LIC9224 forms acknowledging parent receipt of licensing reports from the dates of both 5/2/2024 and 7/11/2024, when Type A deficiencies were cited.

Staff files were reviewed and observed to be complete. Review of staff records confirmed at least one staff member present today has current Pediatric CPR and First Aid certification, and that all staff currently employed with the facility have valid AB1207 Manded Reporter Training certificates. Criminal record clearances were also verified, and facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA referred facility representative to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

Director was encouraged to the visit the departments website at WWW.CCLD.CA.GOV for information regarding childcare updates, forms, regulations and legislation pertaining child care centers. Report continues on 809-C

Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Title 22 Deficiencies are cited on the following pages of this report.

Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided.

A Type A citation is cited on the following 809-D for not adhering to section 102416.5(d)(1) of Title 22 regulations regarding ratio.

A review of facility compliance history revealed that a previous deficiency for the same regulation was cited on 5/2/2024. Due to that date falling within the previous 12 months of today's deficiency, a civil penalty of $250 will be assessed for a repeat violation, accruing $100 per day until the deficiency is corrected.

Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must remain posted for 30 days.
