13 | Licensing Program Analyst (LPA) Jeremey McClain met with licensee David Tucker to deliver findings of a complaint investigation. Upon arrival, LPA observed care and supervision of 13 children by two staff. The following was alleged against the facility:
1)Staff yelled at a child in care, 2) Staff hit a child in care, and 3) Staff do not provide adequate supervision of children while they’re using the bathroom.
During the investigation, LPA conducted interviews with staff and children, reviewed footage of the alleged incidents, and made observations of staff interaction with children. Video footage and interviews did not support any of the allegations. LPA observed staff supervising children during the bathroom as expected and did not observe any inappropriate interaction from staff towards children.
The preponderance of evidence standard has not been met; therefore, the allegations are determined to be unsubstantiated.
There were no Title 22 deficiencies as a result of the investigation. LPA reviewed this report with licensee David Tucker. LPA provided appeal rights. A Notice of Site Visit that must be posted for 30 days.
