On September 12th, 2022, at 11:00 am Licensing Program Analysts (LPAs) Jeremey McClain and Katrina Owens met with Director Jenny Aguilar for the purpose of conducting a complaint investigation. LPAs observed five infants supervised by two staff, and 11 toddlers supervised by three staff. It was alleged that windows in the facility are in disrepair, allowing smoke in the classroom and affecting the air quality. During the inspection today, LPAs conducted interviews with staff and made observation of the windows. LPAs observed that the windows do not close properly, and wet towels are being used at the bottom to prevent air from seeping in. Director stated that maintenance has looked at the issue and determined a special technician is needed to repair the windows in the infant classroom. Based on the evidence that was gathered, the preponderance of evidence standard has been met, therefore, the allegation is determined to be substantiated.

Title 22 deficiencies are cited on the subsequent page of this report. If not corrected, the deficiencies pose potential risk to the health and safety of children in care. Appeal Rights were provided, and an exit interview was conducted. A Notice of Site Visit was posted and must remain posted for 30 days.

Buildings and Grounds. (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidenced by LPA observations and interviews. LPA observations and interviews were conclusive

Director is aware the windows need to be repaired. A maintenance man has inspected the windows and advised that a special technician be hired to make the proper repairs. Director stated that she will submit and emergency work order today to have the windows repaired. Director will send proof of repairs to LPA via video by the POC due date.

that the windows in the infant room do close properly, which allows the air quality to be affected by environmental factors. On Friday 09/09/22, the infant room suffered from poor air quality due to the windows letting smoke in the room from recent fires and the heat wave. This is apotential risk to the health and safety of children in care if not corrected.
