At 8:40am on 5/27/2024, Licensing Program Analyst (LPA) Matthew Gallo and Licensing Program Manager (LPM) Keven Peters met with Applicant Juan Paolo Sarmiento for the purpose of an announced pre-licensing inspection. Applicant requests an infant license to serve 12 infant children from birth to two years of age, with a toddler option to serve up to an additional 12 toddlers from ages 18-36 months. The program will operate Monday through Friday from 6:30 a.m. to 6:00 p.m. The fire clearance was received and granted on 5/8/2024. The facility will be providing breakfast, optional lunch, and snacks. Parents will provide formula, breast milk, and baby food for their children.

LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted. LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

INDOOR ACTIVITY SPACE:

There is one infant classroom and one toddler classroom. In the infant classroom, LPA observed sufficient amount of equipment, toys, tables, chairs, high chairs, cubbies, napping cots, and eight cribs. Applicant acknowledges that there will be a maximum of eight infants under 12 months old, due to the available cribs. As of now, the infant classroom lacks a physically separated area for sleeping. Applicant understands that the partition for the separated sleep area must be 4 feet tall. LPA observed a changing table within arm's reach of one sink. A refrigerator is present. Cleaning disinfectants are appropriately stored and inaccessible to children. Report continues on LIC809-C

In the toddler classroom, LPA observed sufficient amount of equipment, toys, tables, chairs, high chairs, cubbies, and napping cots. Cleaning disinfectants are appropriately stored and inaccessible to children. A changing table is currently not present in the toddler classroom. A partition separating the toddler option from the infant space is also currently not present.

LPA measured the infant and toddler classrooms. The combined classroom space contains a total of 1281.206 square feet, which will accommodate the requested 24 children. Individual measurements are recorded on the Capacity Worksheet (LIC 9024). There is a separate private restroom for the staff which is located in a hallway adjacent to the classrooms. Children who become ill during the day will be isolated in the front lobby area and will use the staff restroom, if necessary. LPA observed a functional carbon monoxide detector in both classrooms. LPA observed an electronic sign-in/sign-out system. Applicant stated there are no poisons or firearms on the premises.

OUTDOOR ACTIVITY SPACE:

Applicant has requested a Shared Outdoor Space Waiver to share the outdoor space currently used by Sterling Montessori preschool, which is located at 821 Sterling Parkway. This waiver will include alternating schedules for the infants and toddlers. The outdoor play area is fenced with a wrought iron fence that is at least four feet tall. Age appropriate equipment and play structures were observed. There are no bodies of water on the premises. There are shaded areas supplied by tree canopy.

The prelicensing report for the preschool license currently using the space lists the area as measuring 1,614 square feet, which will accommodate 22 children at one time.

LPA discussed the following: 100% supervision is required at all times; personal rights; inspection authority; reporting requirements; staff to children ratios and capacity; staff qualifications; and maintaining buildings and grounds. LPA discussed with Applicant any changes that may occur regarding the director or an employee acting in the director's absence must be reported to department within 10 working days.

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. The following items are required before a license will be issued:
1. Photos of four foot tall partition separating the infant crib area from the activity space
2. Photos of a four foot tall partition separating the toddler option from the infant space
3. Photo of a changing table in the toddler classroom
4. LLC in good standing with the Franchise Tax Board
