This is an amended report to update LIC9099D page.
At 4:00pm on 5/28/2025, Licensing Program Analyst (LPA) Matthew Gallo met with facility representative Paolo Sarmiento to deliver findings to the complaint investigation into the above allegations. Upon arrival, LPA observed a census of 8 children consisting of 4 infants supervised by 2 staff and 4 toddlers supervised by 2 staff.
Throughout the course of the investigation, LPA conducted observation, interview, and record review related to the following allegations: (1) Unqualified staff are providing care and supervision to day care children in care.
It was alleged that aides were left alone to supervise children without the presence of a qualified teacher. Through staff interviews and record review, LPA determined that on 5/22/2025, an aide was left alone in the facility with children from approximately 6:52am until a qualified teacher arrived at 7:00am. The preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. Report continues on 9099-C

(2) Staff left day care children unsupervised while in care.

It was alleged that staff left day care children unsupervised while in care. During the investigation, LPA obtained video footage taken of the toddler room during naptime on the day of 5/6/2025. In the footage, a toddler is awake and walking around the facility. No staff member was present in the room to supervise the sleeping toddlers or the toddler who was awake and walking around the facility without supervision.
The preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED.

Title 22 deficiencies are cited on the accompanying 9099-D

Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided.

An immediate civil penalty of $500 is also assessed on the following LIC421IM due to the instance of absence of supervision.

Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must remain posted for 30 days.

Director Sarmiento refused to develop a plan of correction due to disagreeing with the finding that an absence of supervision occured and his belief that corrections are therefore not required. LPA will conduct a plan of correction visit.

Based on review of video record and interviews, the licensee did not comply with the section cited above due to staff not being present in the toddler room to supervise a child who was awake and walking around. This posed an immediate health, safety, or personal rights violation to persons in care.

Director Sarmiento will provide LPA Gallo with a staff schedule for the next week showing that a qualified teacher will always be present in the morning to accept children. LPA will conduct return visit to ensure compliance.
