At 9:30am on 2/13/2026, Licensing Program Analyst (LPA) Matthew Gallo met with director Paolo Sarmiento to open a complaint investigation into the above allegation. During the the visit, LPA observed a total census of 8 children supervised by 1 staff.

Throughout the course of the investigation, LPA conducted record review and interviewed parties relevant to the allegation that staff transported daycare children in an unregistered and uninsured vehicle. In interview, director Paolo Sarmiento stated that a 2007 Honda Odyssey used to transport school aged children was involved in a minor scrape of a parked car at a public school on 2/6/2026, prior to children entering the vehicle. Director stated that, in the course of exchanging information with the owner of the scraped car, they discovered that the facility vehicle's car insurance policy covering the vehicle was no longer valid.

With information gathered through a phone call with insurance representatives, LPA determined that the insurance policy for the 2007 Honda Odyssey was cancelled on December 22, 2025 due to non-payment. Director provided current proof of liability insurance for the 2007 Honda that became effective 2/7/2026. Director additionally stated that a 2005 Dodge Caravan has also been used to transport children within at least the past two weeks. Through a phone call with insurance representatives, LPA determined that an insurance policy for this vehicle was acquired in the middle of LPA's 2/13/2026 visit and is effective from 2/13/2026 onwards. Director stated that this vehicle was formerly covered by the policy that was canceled on December 22, 2025.

Through review of DMV records, LPA determined that the 2007 Honda Odyssey did not have up to date registration status as of 2/9/2026 and that the 2005 Dodge Caravan did not have up to date registration status as of 2/10/2026.

A Type A Title 22 deficiency is cited on the following LIC9099-D

LPA Matthew Gallo informed facility representative Paolo Sarmiento that this report dated 2/13/2026 documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Gallo informed the facility representative to provide a copy of this licensing report dated 2/13/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must remain posted for 30 days. LPA provided appeal rights.

Proof of active insurance has been provided for the 2007 Honda Odyssey and the 2005 Dodge Caravan. Licensee stated that children will not be transported in either vehicle until they provide LPA with proof of valid registrations. LPA will conduct return visit to ensure compliance.

Based on interview and record review, the licensee did not comply with the section cited above due to transporting children in a vehicle that did not have valid registration or legally required liability insurance that would cover injuries to passengers in the car. This poses an immediate health, safety, or personal rights risk to persons in care.
