At 1:45pm on 3/5/2026, Licensing Program Analyst (LPA) Matthew Gallo met with facility representative Paolo Sarmiento to open a complaint investigation into the above allegation. Upon arrival, LPA observed 11 children supervised by 1 staff.

It was alleged that staff did not adhere to regulations requiring the public posting of licensing reports documenting Type A deficiencies for 30 days. A review of facility compliance history shows that the facility was cited Type A deficiencies twice within the last 30 days, on 2/13/2026 and 2/26/2026. During today's visit, LPA observed that neither of these reports were posted as is required by regulations. The preponderance of evidence standard has been met; therefore, the allegation is SUBSTANTIATED.

An immediate $100 civil penalty is assessed for not adhering to posting requirements for licensing reports documenting Type A deficiencies.

Exit interview conducted and report was reviewed with the facility representative, Paolo Sarmiento. A notice of site visit was given and must be posted within 30 days. LPA provided appeal rights.

1596.8595(a)(1) ) Each licensed child day care facility shall post a copy of any licensing report...that documents either a facility visit....that results in a citation for a violation that, if not corrected, will create a direct and immediate risk to the health, safety, or personal rights of children in care. The licensing report provided by the department shall be posted immediately upon receipt...and shall remain posted for 30 consecutive days.

This requirement was not met as evidenced by: Based on observation, the licensee did not comply with the section cited above due to not posting licensing reports documenting Type A citations issued on 2/13/206 and 2/26/2026. This poses a potential health, safety, or personal rights risk to persons in care.
