On 01/19/2024, Licensing Program Analyst (LPA) Lorena Valenzuela met with Bermuda Dunes Learning Center Director Barbara Weeks to deliver the findings of the complaint investigation for the above allegation. The investigation included an inspection of facility and a review of facility records on 12/01/23. In addition, LPA interviewed Director, two staff, and an interview with a relevant party.
On November 21, 2023, Community Care Licensing (CCL) received information that staff did not prevent day-care child from ingesting a foreign object while in care. It was reported Child 1 (C1) had ingested a marble while in care.
Confidential interviews revealed the facility has a toy that uses a marble as part of the toy’s materials. Interviews revealed staff will introduce the rules and procedures before children are allowed to use the toy with marble. Interviews revealed staff visually supervise children and when using the toy involving the marble staff will ask children periodically where the marble is. Additionally, the staff will lock the marble when not in use by children.

Records review indicated the toy was age appropriate for the children in care. In addition, records indicate there was appropriate staff to children ratios on the day of the incident.
Based on interviews and records review, the allegation that staff did not prevent day-care Child 1 (C1) from ingesting a foreign object while in care, may have occurred, however is not supported or proven by evidence. Therefore, the allegation is unsubstantiated at this time.

A copy of this report, appeal rights and Notice of Site Visit were provided to Teacher, Barbara Weeks.

The Notice of Site Visit was posted by the licensee prior to LPA leaving the facility and the licensee was reminded this notice must be posted for 30 days.
