On the above date and time listed, Licensing Program Analyst (LPA) Nasha King arrived at the facility for the purpose of delivering the complaint findings into the above-referenced allegation. LPA met with Assistant Director, Laura Martino. LPA toured the facility, conducted census, and discussed with Ms. Martino the conclusion of the complaint investigation.

On May 5, 2022, Community Care Licensing (CCL) received a complaint, alleging authorized representative denied access to child's records. An initial 10-day visit was conducted on May 09, 2022, by LPAs Nasha King and James Wilkerson. LPAs King and Wilkerson conducted a tour of the facility and observed no immediate safety hazards or concerns. Confidential interviews were conducted with two staff members (S1 & S2). LPAs also reviewed and obtained copies of child one's (C1) file, and the investigation was extended at that time.

In regard to the allegation authorized representative denied access to child's records, confidential interviews revealed that Parent Two (P2) was initially denied access to C1’s school file, as facility staff were unaware of the identity/relationship of P2 to C1. Information obtained also revealed that Parent One (P1) did not list P2 on the Father/Guardian’s Name Section of the Boehm Child Development Center Application nor was P2 listed on the Identification and Emergency Information Child Care Centers (LIC 700) Form. Records obtained and reviewed by LPA corroborated the information obtained in the confidential interviews. Facility staff was unaware that this individual was the parent of C1, however, after verifying who the individual was by seeing proof of identification and court order documents, facility staff were willing to work with P2 and provide access to certain records in C1’s file. Additionally, facility staff advised P2 to fill out facility documents and Licensing documents so that a file could be created for P2; P2 completed the forms and a file for P2 was created.

Based on confidential interviews and records review, LPA has determined that no violation of Title 22 occurred. Additionally, due to lack of cooperation with the Reporting Party, LPA was not able to retrieve additional information regarding the allegation. Therefore, LPA was unable to corroborate the allegation.



Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with the Assistant Director, Laura Martino, and a copy was provided. LIC 811- Confidential Names List was also provided to the Assistant Director.

Appeal rights were discussed and provided during the exit interview.

A Notice of Site visit was given, and the Licensee understands that it must remain posted for 30 days.
