On July 13, 2022 at 11:57 AM, Licensing Program Analyst (LPA), Anastasia Flores conducted an annual inspection as part of a compliance review. LPA was greeted and granted access to the facility by staff, Nicole Herrera. This is a combination childcare center and the other licensed programs is: Infant Program which was not inspected on this date. At 12:10 PM, LPA Flores toured inside and outside of the facility and the following was observed and/or noted:
· The following items were posted and updated where necessary:
- License
- Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148)
- Parent’s Rights Poster (PUB393)
- Personal Rights (LIC613A)
- Child Car Seat Law
- Menu
· The facility is operating within the limits as stated on the license.
· Ratios are being met during this inspection
· Classrooms are adequately equipped with age and size appropriate furniture and equipment and free of hazards.
· There are no weapons present at the facility as stated by Treasure Nottingham
· There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· A water supply of drinking water in the indoor/outdoor activity space was observed the children use a water machine by the back door of the room leading to the outdoor play area.
· Crystal Edwards, Director stated the facility does not take in children that take medication.
· Hazardous items are stored where inaccessible to children which include: Disinfectants, cleaning solutions and other items that are dangerous (Facility is being cited for Lysol and Glade Aerosol spray accessible to children at time of inspection)

·Poisons and toxins are locked and inaccessible to children in a cabinet
· All floors were observed to be clean and safe
· Bathrooms were observed to be safe, sanitary and in operating condition
· Playgrounds are enclosed by appropriate fences and free of hazards
· Outdoor activity areas are supplied with age and size appropriate equipment in good condition
· Food preparation area is clean, free of litter, rubbish and free of rodents and other vermin
· Food is stored appropriately and protected from contamination
· All storage containers for solid waste, including moveable bins shall have tight-fitting covers that are kept on, and in good repair
· Sign in/Sign out record was reviewed and meets regulation requirements
· Disaster drills to be conducted every six months – last drill conducted on 04/28/22.
At 12:43 PM, a review of staff and children's records were conducted as part of this evaluation.
· Children’s records were found to be complete during this inspection. LPA asked Crystal Edwards to have immunization transferred to the Blue Health and Safety forms and send proof to LPA via email.
· Staff records review indicates that all staff present meet minimum qualifications for the position for which they were hired.
· A Staff member is present with current Pediatric CPR/First Aid which expires on 04/11/24.
· Opening and closing staff member’s CPR/First Aid expires on 04/11/24.
· Director completed Health and Safety Training
· A review of staff records on 07/13/22 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following items were discussed with the Licensee/Director during inspection:


· Menus shall be posted at least one week in advance in a place visible by the child’s authorized representative, dated and kept on file for 30 days, and made available upon request.
· Uncontaminated drinking water shall be readily available both indoors and outdoors

·The areas around or under high climbing equipment, swings, slides, and similar equipment shall be cushioned with material that absorbs a fall

LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Based on LPA observation and interview], the licensee did not comply with the section cited above, there was several sharp objects in a cabinet under the sink in the preschool room and the child safety lock was broken. Staff Nicole stated the director just ordered a new child lock for the cabinet and it should be here next week. This poses a potential health, safety or personal rights risk to persons in care.
