32 | During the visit on June 18, 2025, LPAs saw Staff #2 alone with eight children, including one infant, four toddlers (2 years old), one 3-year-old, and two 4-year-olds. A review of the children’s records confirmed that none of the children were school-aged, and there was no documentation of school enrollment for the two 4-year-olds. Therefore, the assistant was operating out of ratio and over capacity. This allegation is substantiated, and the facility is being cited for violating Title 22, Section 102416.5(e) regarding staffing ratios and capacity. This is a repeat violation, and a $250 civil penalty will be issued.
Additionally on June 18, 2025, LPA Naomi Hurtado and LPA Sumayya Habeebulla observed an unlicensed location where children were being dropped off. Between 6:45 a.m. and 12:32 p.m., six children were seen entering the unapproved site. When LPAs attempted to make contact, the person who answered the door denied that children were present, though LPAs heard voices inside. Law enforcement was called for a welfare check. Although the person at the door refused entry, they called children to the door, and five children appeared. Three of them were listed on the Licensee's roster. However, LPAs could not verify the identities of two additional children previously observed entering the home. Based on these findings, this allegation is substantiated, and the facility is being cited for violating Title 22, Section 102368(b) regarding use of unlicensed locations.
A Notice of Site Visit was issued and must be posted near the facility’s main entrance for 30 days. Not posting it will result in a $100 penalty.
The Licensee was informed that this report must be shared with all current parents/guardians by the next business day (or the next time the children are in care), and with all newly enrolling families for the next 12 months. A signed acknowledgment form (LIC 9224) or written confirmation must be kept in each child’s file.
An exit interview was conducted, and the Licensee Claudia Garcia received a copy of this report, the LIC 9224 form, and information on appeal rights. |
