32 | The facility utilizes the Brightwheel application to document and communicate/notify parents/authorized representatives of any issues concerning their children. This includes any incident that the children are involved in and observed. In reviewing the child’s record/file, via Brightwheel, there was no documentation of an incident or observation of scratches during the morning health check. The only information available regarding the scratch(es), in the Brightwheel application, was a message from staff to the parent/authorized representative of the child. In the message, staff acknowledged the scratches as if they were previously there and not fresh or recent. The message did not specify what day the scratch(es) was first observed. Information was obtained but not verified, that the child had returned from winter break on 1/3/2023, with scratches on their face. Licensee disclosed that video footage from facility cameras show the child without a scratch(es) on the morning of 1/5/2023 but no video footage of the child leaving with them. Pictures were also obtained and reviewed however, those pictures that clearly show the scratch(es) on the child nose/face, were taken after 1/5/2023. Staff recalled observing and discussing the scratches at some point but could not specify what day that was. There was no clear or definite information obtained as to how or where the child may have suffered the alleged scratch(es).
Based on the lack of documentation and specific information available, it was determined that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
