Licensing Program Analysts (LPA) Otsanya Cameron conducted a Tele-inspection for the purpose of delivering the findings for the above allegation(s). LPA spoke with Center Owner Rachel Choi who confirmed the census of 57.

On 8/7/2020, The department received a complaint of Staff not allowing children to eat their lunch.

It was a alleged that a teacher did not allow a child in care to eat their lunch brought from home. Based on interviews and record review, it was discovered that no clear policy exists regarding food brought from home and what can or cannot be done with it. It was disclosed during the interviews that the understanding of the staff is to offer the school's lunch first and the food brought from home can be eaten afterwards. Children could eat food they brought from home during designated lunch or snack times, but were not allowed to freely eat throughout the day. Additionally, if there is an allergy/ Dietary need, a child could bring outside food, but would be separated from other students to avoid potential exposure or allergic reaction. There does not appear to be any staff denying a child to eat the food they brought from home.

Licensing Program Analysts (LPA) Otsanya Cameron conducted a Tele-inspection for the purpose of delivering the findings for the above allegation(s). LPA spoke with Center Owner Rachel Choi who confirmed the census of 57.

It was alleged that a staff did not notify parent of injury.
Interviews were conducted with all pertinent parties. The Interviews revealed that an injury did occur and parent(s) were not notified. It was determined that a teacher was on the playground with approximately 10 children. While attending to one child on one side of the playground, another child was injured. Staff was aware of the injury and even provided an ice pack for the child, but did not provide an immediate account of the injury in an incident report or notify the parent as required by the facility’s plan of operation.

Based on this information, the preponderance of evidence standard has been met, therefore the above allegation/s is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, divisions & chapter number) are being cited on the attached LIC 9099D.

on reporting policies regarding injuries when and how to report. Owner will consider revamping or writing a more thorough policy in handbooks and have teachers sign and acknowlegedment of understanding.

The department has investigated the complaint alleging: Staff not allowing children to eat their lunch and found it to be Unsubstantiated: “Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
