On December 12, 2023, at 1:11 PM, Licensing Program Analyst, Anastasia Flores met with staff, Ania Vasquez, to deliver the findings on the above stated allegations. Licensee was not present due to being out of the country on a family emergency. On September 27, 2023, at 9:36AM, LPA Flores conducted a health and safety inspection of the facility, and no immediate concerns were noted. Copies of pertinent documents from the facility and children’s files were obtained. Interviews were conducted with four staff and 11 confidential interviews.

On September 18, 2023, a complaint was received alleging staff handled day care child in a rough manner, specifically that staff#1 (S1) grabbed child #1(C1) by the arm, sat C1 in a chair in a rough manner. Seven of 11 confidential interviews disclosed that S1 is not nice and S1 has put children in a chair for timeout in a rough manner on at least one or more occasions. Additionally, confidential interviews described S1 as a mad or mean teacher and on at least one or more occasions S1 has been observed to put one or more children in time out in a chair or at the table aggressively placing her hands on the shoulders of children.

Interview with S1 denies placing hands on the children at any time. Interview with S1 revealed the discipline with the children in care is to talk with the child when they do something wrong. If that doesn’t resolve the issue, the staff remove the child from the classroom. If the child continues to be naughty and does not listen, S1 will talk with the parents. 5 of 5 confidential interviews denied seeing any staff place hands on children in care. Record review of discipline policy revealed the children will be removed from the situation by sitting in a particular chair or quiet spot for one to two minutes. Policy reveals that the children need to feel safe and secure while learning to get along with others and in society and that descriptive praise, encouragement and rewards build self-esteem and encourage good behavior in children.
Based on confidential interviews and record review, the preponderance of evidence has been met and the allegation that staff handled day care child in a rough manner is substantiated. The facility is in violation of Title 22, Section 101223(a)(3) Personal Rights which poses an immediate health, safety and/or personal rights risk to children in care.
The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.

The Facility representative shall post and provide copies of the report to parents/guardians of the children currently in care at the facility by the next business day and provide copies to the parents/guardians of newly enrolled children at the facility during the next 12 months. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file.

An exit interview was conducted, a copy of this report, 9099D, LIC9224, & appeal rights, along with a Notice of Site Visit was handed to facility representative, Ania Vasquez.

Licensee agrees to provide a written statement explaining the importance of providing dignity to all children in care per Title 22 Regulations on Personal Rights. The letter will be provided to LPA Flores via email by 12/19/23. Due to licensee being out of the country until Monday 12/18/23, The POC has been extended until 12/19/23.

Based on observation and record review, S1 handled day care children inappropriately on one or more occasions by placing their hands on the child’s shoulders and forcing the child to sit down. This is an immeditatel health, safety and personal rights risk to children in care.

On September 18, 2023, a complaint was received alleging that staff hit a day care child resulting in a bruise specifically that staff #1 (S1) spanked Child #1 (C1) on the bottom, and then grabbed C1 by the arms and forced C1 to sit down in a chair. Additionally, it was alleged that C1 obtained two bruises on C1’s legs from S1 forcing C1 to sit crossed legged during circle time. Confidential interviews disclosed that on at least one occasion S1 has been observed to place C1 in time out with their head down, which makes C1 cry.

Interview with S1 stated that C1 did not like to sit at the table and denied making C1 sit down with their legs crossed. S1 stated that C1 knew how to sit with legs crossed and that C1 was naughty and did not like to listen, comparing C1 to another child the same age. Additional confidential interviews denied staff ever using spanking or pow-pow as a form of discipline.
Based on interviews, the allegation that staff hit day care child resulting in a bruise, may have occurred, however, it is not supported or proven by evidence. Therefore, the allegation is unsubstantiated at this time. A copy of this report, appeal rights and Notice of Site Visit were provided to Facility Representative, Ania Vasquez.
Facility representative, Ania Vasquez, was reminded that the Notice of Site Visit must be posted for 30 consecutive days and failure to post the notice will result in civil penalties of $100.00.
