On 02/13/2024 at 8:45 AM, Licensing Program Analysts (LPAs) Giselle Carbullido and Tiffanie Diep met with Directors Trudy Oliver and Tanya Soleski for the purpose of an unannounced annual inspection. Entrance Checklist (LIC 125) was provided to Directors, and Directors guided LPAs on a tour of the facility. LPAs observed three staff supervising eight children. Facility days and hours of operation are Monday through Thursday from 6:30 AM to 6:00 PM and Friday from 6:30 AM to 5:15 PM. LPAs verified that annual fees are current.

All individuals subject to a criminal record review have obtained a criminal record clearance. Directors were reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of five days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

A health and safety inspection of the facility’s interior and exterior was conducted. LPAs reviewed the sign-in/out sheets and observed that children were properly signed in/out. LPAs observed the required postings. LPAs reviewed staffing ratios, first aid supplies, furniture, equipment, fire drills, and access to drinking water. LPAs reviewed storage of refrigerated bottles which were properly dated and labeled with children’s names. LPAs observed cribs were available for each infant under 12 months old and cots were available for infants over 12 months old. LPAs observed a changing table within arm’s reach of the sink. LPAs verified that hazardous items (disinfectants, cleaning solutions, etc.) were inaccessible to children in care. LPAs observed both smoke and carbon monoxide detectors were functional. LPAs observed adequate age-appropriate toys and equipment available for children.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every five years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was not completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. LPA referred Directors to the Department website for lead: Lead Toxicity Prevention and Water Testing Information. Facility is working with Environmental Laboratory Accreditation Program (ELAP) vendor to complete the process due to an error found in the initial testing report.

LPAs reviewed children’s files and verified each child’s file contained required documents, including a needs and services plan and emergency information. LPAs reviewed staff’s files and observed required documents, including health screening reports with TB clearance and required immunizations. LPAs verified all staff have current Mandated Reporter Training certificates. LPAs verified at least one staff member present has current EMSA pediatric CPR and first aid certification which expires on 05/27/2024.

LPAs discussed the safe sleep regulations with Directors and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed Directors of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPAs observed three infants in baby bouncers and discussed with Directors that baby walkers, bouncers, exersaucers, and other similar items are prohibited. Directors removed the bouncers from the classroom and stated they will no longer use them. LPAs observed 15-minute sleeping logs for infants under 24 months and a copy of the Individual Sleeping Plan (LIC 9227) for infants under 12 months during the inspection.

Directors were informed of the MyChildCarePlan.org website, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Based on LPAs’ observations and interviews conducted, a deficiency is being cited on the attached LIC 809-D. LPAs Giselle Carbullido and Tiffanie Diep informed the director, Trudy Oliver, that this report dated 02/13/2024 documents one Type A citation which shall be posted for 30 consecutive days as there was an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA informed Director to provide a copy of this licensing report dated 02/13/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgment of Receipt of Licensing Reports (LIC 9224), or other written statement, must be placed in the child’s file for verification.

An exit interview was conducted and report was reviewed with the director, Trudy Oliver. A notice of site visit was given to Director and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
