On 06/18/2021 at 11:32am, Licensing Program Analyst (LPA) Destinee Hogue conducted a case management inspection with Director, Monique Garcia. A case management inspection is being conducted in response to the receipt of an unusual incident report (UIR) from the facility. The UIR was received by the licensing agency on 05/19/2021. On 06/01/2021, an in-person inspection was conducted by LPA Hogue. During the inspection on 06/01/2021, LPA Hogue interviewed pertinent parties, reviewed records, and conducted facility observations.

During this inspection, LPA Hogue toured the facility inside and outside, took census of daycare children present on this date, verified facility associations, and discussed the following with Director, Monique Garcia.

On 05/18/2021 at approximately 10:00am, a child in the Garden Classroom was left unattended and found in the facility parking lot. The classroom had completed their time on the playground and began lining up to return inside the facility. The first count was done inside the playground. Once children were accounted for, staff opened the playground gate, and directed the children to sit on the curb (located on the outside of the facility playground fencing). Children and staff cleaned off theirs shoes and began lining up to return inside the facility. Children and staff walked through the outside foyer which is between the school building and parking lot. The class arrived at the facility door (near front office entrance) and staff opened the door and began calling children inside.



One by one, the teachers started lining up the children inside the facility. Staff #1 leads the class and calls out children’s names to line up inside. Staff #3 is in the middle of the line monitoring children, and Staff #2 is in the back of the line. Standing inside the facility, Staff #1 calls children one by one inside and has each child line up against the wall. As children are brought inside the building, Staff #3 stood at the door, while Staff #2 remained outside with end of the group. When Staff #2 realized the group was toward the end, he/she went inside the building and closed the door. At this time, Staff #1, Staff #2, Staff #3, and children present in the Garden Classroom were inside the building.

Once all children were inside and lined up on the wall, Staff #1 began taking roll and started counting the children on the wall. While Staff #1 was counting he/she realized that Child #1 was not present inside the building. While the Garden Classroom transitioned inside the building and while Staff #1 was recounting the children, Dr. Lisa Gilfillan received an anonymous phone call at approximately 10:06am, stating a child was observed outside the facility, near the front of the school building.

When Staff #1 realized the child was missing in the count, he/she directed Staff #2 to leave the group and search for the child. As Staff #2 began his/her search, Dr. Lisa Gilfillan walked inside the facility with Child #1 and reunited Child #1 with Staff #2. Staff #2 and Child #1 returned to the Garden Classroom.

According to interviews conducted with involved parties. Child #1 was counted in the first round of counting which was by the playground fencing. According to interviews, Child #1 wandered out of the facility when Staff #1 went to retrieve three other children who got out of line while inside the school building. Staff present the day of the incident, do not recall observing Child #1 getting out of line and/or leaving the school building.

Based on information obtained, LPA Hogue has determined that the facility violated Title 22, Division 12, Chapter 1, Article 06. Continuing Requirements. 101229 Responsibility for Providing Care and Supervision.

A Civil Penalty has been assessed during this inspection. Payment is due when billed and the check(s) or money orders shall be made payable to the “California Department of Social Services”. YOU WILL RECEIVE AN INVOICE IN THE MAIL. DO NOT SEND MONEY UNTIL YOU RECEIVE YOUR INVOICE. DO NOT SEND CASH.

A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE/DIRECTOR UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS ALONG WITH A COPY OF ALL TYPE A DEFICIENCIES (LIC809 & LIC809D) CITED DURING THIS INSPECTION. A COPY OF ALL TYPE A DEFICIENCIES CITED DURING THIS INSPECTION MUST ALSO BE IMMEDIATELY (WITHIN 24 HOURS OF THE CHILD’S NEXT DAY IN CARE) GIVEN TO THE PARENTS OF ALL CHILDREN ENROLLED IN THE CHILD CARE FACILITY AND ANY CHILDREN ENROLLED INTO THE CHILD CARE FACILITY OVER THE NEXT 12 MONTHS (AT THE TIME OF ENROLLMENT). A copy of this report was provided to the Licensee/Director on this date and must be made available to the public upon request for the next 3 years

Immediately staff agree to account for all children and maintain visual observation throughout the day. On 05/19/2021, staff watched a YouTube training video on supervision and provided a copy of sign in sheet on 06/01/2021. Director stated she is providing more oversight by following up with staff before and after classroom

Based on interviews conducted and a self-reported incident report, the facility has admitted to not observing a child wandering out of line and exiting the school building. This resulted to Child #1 wandering and being found in the school parking lot. This is an immediate health, safety, and personal rights risk to children in care. A Civil Penalty was assesed.
