On April 20, 2023 at 11:00 am, Licensing Program Analyst (LPA) Jessica Rubio arrived unannounced to Growing Tree Montessori Preschool, (CCC) to deliver the investigative finding of the allegation listed above. On February 22, 2023 at 10:45 am, LPA Rubio initiated the investigation, and conducted a tour and census of the CCC. During the investigation, LPA Rubio also conducted interviews with six staff.

On February 16, 2023, a complaint was received alleging facility is out of ratio, specifically that classrooms are out of ratio. Several interviews revealed that classrooms sometimes combine during nap time due to staff shortages and to rotate staff breaks.

Interviews revealed that there have been times one teacher or aid is supervising 22-26 children during nap time. It was revealed that it is a common occurrence in some classrooms to have two to three and sometimes more children not napping, out of their cots and running around during nap time, with still only the one staff supervising.

Based on confidential interviews conducted during the investigation, the preponderance of evidence standard has been met and the allegation that facility is out of ratio is substantiated. The facility is being cited for Title 22 Regulations Section 101230. See LIC 9099-D for cited deficiencies.

An exit interview was conducted, appeal rights discussed and given to the licensee along with a copy of this report was provided to Director Julia Fletes. A notice of site visit was also provided and must remain posted for 30 days.

Director Julia Fletes stated she would submit a plan to ensure if children are not napping during nap time, the class is still in appropriate ratio.
