32 | The Licensing Program Analyst (LPA) Samuel Lopez investigated the above allegation and the following was gathered: In the course of the investigation it was learned that a parent arrived at the facility, to pick up their child, accompanied by local law enforcement. However, the licensee refused to release the child. Per licensee’s own admission, a court order outlining custody details between both parents, had been obtained, prior to the child’s enrollment. The licensee was aware of the days and times that each parent had custody or visitation rights to. On the date and time in question, the parent that arrived to pick up their child, had legal right to do so. No current or new legal documents had been provided stating that custody had been revoked for any of the parents. The licensee knowing this information still waited between 20 to 30 minutes before re-reviewing the court order and releasing the child.
Based on licensee’s own admission, interviews conducted, and a review of additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation regarding the licensee not following a court order, is found to be Substantiated.
