On the above date and time listed, Licensing Program Analyst (LPA) Nasha King arrived at the facility for the purpose of delivering the complaint findings into the above-referenced allegations. LPA met with Jean Espino, Director. LPA toured the facility, conducted census, and verified facility staff and children enrollment. During this visit, LPA did not observe any immediate safety hazards or concerns.

On August 17, 2022, Community Care Licensing (CCL) received a complaint, alleging that day-care child sustained injuries while in care and that day-care child is not cleaned after feedings. An initial 10-day visit was conducted on August 19, 2022, by LPA King. During this visit, LPA reviewed and obtained copies of facility records, and the investigation was extended at that time. On October 20, 2022, and October 24, 2022, LPA King conducted subsequent visits to the facility to interview staff pertinent to the investigation. During these visits, LPA did not observe any immediate safety hazards or concerns.

Regarding the allegation day-care child sustained injuries while in care, it was alleged that on 08/09/2022 child #1 sustained injuries that appeared to be a black eye and three to four scratches on their face. Confidential interviews revealed that C1 did not sustain any injuries that resulted in a black eye, and the facility staff were unaware of the injury, especially because the child did not have a black eye when being picked up. Confidential interviews revealed that C1 did sustain three small scratches (two under the eye and one on the nose) from a peer, however, the child’s parent was notified of the incident and was made aware of how C1 obtained the scratches. It was also revealed that the day that the incident occurred, there was adequate staffing inside the classroom and the injuries did not result from a lack of supervision or neglect.

Regarding the allegation day-care child is not cleaned after feedings, it was alleged that child #1’s (C1) parent came into the classroom during nap time and found C1 on the floor with their face covered in dried out food. Confidential interviews revealed that the children had just finished eating their lunches and were transitioning into nap time. With lunch just ending, not all children had a chance to have their diaper changed or their faces washed. C1 was laying down on the mat while waiting to be cleaned. Confidential interviews also disclosed that the staff member who was conducting the face washing/cleaning of the children was cleaning the children one by one. C1’s parent arrived at the facility during the transition, and it was observed that C1 was lying down being patted on the back by a staff member. It was also observed that C1 was still awake. Parties interviewed did not deny the allegation that C1 had not been cleaned prior to her being laid down. However, the classroom only contains one sink, and therefore the children had to take turns being cleaned. LPA has determined that this incident did not occur due to a lack of neglect.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with Jean Espino. A copy of the report was also provided.

Appeal rights were discussed and provided during the exit interview.

A Notice of Site visit was given, and the Licensee understands that it must remain posted for 30 days.
